Resolution 233-1981RESOLUTION NO. 233 -1981 WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from. Peter Whittier , and Ti'TF 'PPTF , in cer-pl.iance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows! This project involves the placement of 1.845 cubic yards of rirrap below PIHra to stabilize 380 lineal feet of residential shoreline. The applicant has also proposed the excavation of 80' x 35' x -6' MSL boat basin from the uplands, involving 1045 cubic yards. Although not mentioned in the application, the basin excavation will neces- sarily involve at least 120 cubic yards below MHW to connect the basin with deeper offshore waters. Finally, an 80' long by 15' wide dock is proposed adjacent to the proposed basin. Incorporated into the basin is a riprap retaining wall which will be constructed at a +2.0 foot NISL elevation. From this retaining wall the basin will slope down to MFW for 15 feet, forming a "beach". A. 2.1 side slope will then reach the desired depth of -6 feet MSL, which will be uniform over the entire basin bottom (final bottom width of 23 feet) . On the eastern side of the basin an 80' long by 8' wide perimeter dock will be constructed for the length of the basin, with riprap place underneath for stabilization. The riprap to be placed will be 15 feet wide. The site plans do not indicate the MLW line on the cross sectional view (Section A), however, some of the riprap is expected to extend beyond MLW as the applicant now proposes. No mention is made by the applicant of the equipment or construction techniques to be used. Stated purpose of this project is to provide boat dockage and to prevent shoreline erosion. The body of water adjoining the applicant's property was partially dredged from low mangrove -dominated wetlands in the late 1950's or 60's for the purpose of creating waterfront upland sites. Although this waterbody is partially artificial, it still retains a semblance of its original open water shoreline in some areas. A country club and its associated golf course now line most of the shoreline peri- meter, although several houses are located to the east of the appli- cant's property. These properties have been vertically bulkheaded. Because of the spoil characteristics of the shoreline and upland land base, erosion is common but not severe. The shoreline typically graduates gently from the erosion 1.-J.r,.e down into the water past MLW where it then drops sharply to deep water. These deeper waters were dredged to an unknown depth and have typically low transparency (as compared to natural outside waters). Veaetation in the area along the shoreline is, in general, very limited. The applicant's shoreline is nearly uniform over its entire length. Small buttonwoods (Conocarpus erecta), black mangroves (Avicennia germinans) and scattered sea daisy (Borrichia sp.) were observed along the water line. The uplands are relatively low and the drop from these uplands to the littoral shelf is more gradual than that found on many other higher lots in the area The graduating shelf from the erosion line down to the edge of the deep -water dropoff is barren of benthic colonization of any type, excepting some small snails (Cerithidea sp.). The substrate here is loose limerock rubble. The only observed biota in the area were several neddlefish (Strongylura notata). The width of this shelf varies from ten to twenty feet, at which time there is a sharp drop in depth. The primary concern here is water quality maintenance within the pro- posed basin, Due to the poor water transparency of outside waters, seagrass or algal _growth over the basin bottom is unlikely. Because of this and poor water circulation that is expected within the basin, dissolved oxygen levels could be marginal. It is felt, however, be- cause of moderate depths and the absence of any detrital buildup along this shoreline that this basin should not develop oxygen defi- ciencies in violation of water quality standards. Of secondary concern is the waterward extent of the riprap placement as it is proposed. By placing the riprap beyond the line of MLW, a potentially valuable marine substrate will be eliminated. Based upon biological and water quality criteria, in accordance with Chapters 253 and 403 of the Florida Statutes and Chapters 17-3 and 17-4 of the Florida Administrative Code, approval of this application is recommended with the following conditions suggested: 1. Riprap should not be placed below the line of MLW (total width of riprap not to exceed 12 feet). 2. A backhow should be used for all basin dredging to insure an even and. controlled depth of -6 feet MSL. 3. Turbidity screens should be used during all dredging activity. DISCUSSION: Applicant proposes to place 31)0 linear feet of rip -rap along, his waterfront property t`lat abuts an unnamed lake. A tributary/ canal connects this lake with Sisters' Creels, Approximately 1345 c.v. of rip -rap will be placed beloi:T the j111W line in the construction of the seawall (see DER report). Also 'proposed is an 10' x 35' x -6' TISL boat basin to be excavated `rom the uplands (631?t c.y.). Accordin^ to the DER report, another 120 c.y. will be needed to connect the basin wit", the deeper waters of the lake. Rip -rap boulders will be used to line the interior of the basin. Because of this and poor water circulation that is expected within the basin, dissolved oxygen levels could be marginal. It is felt, however, because of moderate depths and the absence of any detrital buildup along this shoreline that this basin should not develop oxygen deficiencies in violation of water quality standards. Of secondary concern is the waterward extent of the riprap place- ment as it is proposed. By placing the riprap beyond the line of MLW, a potentially valuable marine substrate will be eliminated.
