RESOLUTION NO. 297 -1981 WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from PARMELEE ESTATE and, WHEREAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows: The applicant proposes to place 10,500 cubic yards along and area purported to have been eroded by hurricane Betsy as per his diaaram accompanying his application. The fill will be placed by dumptruck and bulldozer. Biophysical features of general area (include comments concerning extent of development of adjoining properties). The area was cleared and filled in 1963 adn 1964. Australian Pines and palm trees were planted throughout the property. One (1) house has been erected on the property. To the west exists Port Antigua, a single-family residential canal subdivision with approximately 5% of the lots occupied. To the South exists another single-family residential canal subdivision with approximately 60-70% of the lots occupied. Matecumbe Bight surrounding the applicant's property is around -6' to -7' deep offshore. Nearshore the depth is reduced to -1' to -2'. Biophysical features of specific work site and spoil site when appropriate (include identification of bottom types). The shoreline along the project area appears to be over five (5) years old. The boulder riprap line was placed (according to Bruce Jetter, Game & Fish Commission) "on or about April 10, 1970." Upland vegetation is not indigenous, being either Australian pine or coconut palm. The boulder riprap line has been well vegetated by red, green, and brown algae, including Laurencia spp., Dictyote spp., Batophora spp., and Acetabularia spp. Coelenterates, sponges, mollusks, and other marine organisms utilize the rip - rap along with a multitude of fish. The area between the shoreline and riprap has become colonized by Thalassia spp. and Halodule spp. along with Penicillus spp., Acetabularia spp., Batophora spp., Udotea spp., Dictyota spp., and Halimeda spp. This vegetation stabilized shifting sediments, increases dissolved oxygen through photosynthesis and provi.des habitat for a multitude of marine organisms such as mollusks, shrimp, polychaetes, crabs fish, tunicates and coelenterates. The substrate in this area consists of shell fragments with fine marl sediments. Impacts of project on bioloigcal resources. Address long-term impact as well as immediate impact. All aspects of proposal should be assessed in these terms. The immediate impact of the proposed filling to reclaim land would be to elimi- nate a biologically productive area of baybottom behind the boulder riprap/ Long-term impact would manifest itself through the loss of shallow productive baybottom. Loss of shallow water habitat is a cumulative effect resulting in a possible decrease of marine vertebrate and invertebrate species. It also increases the possibility of water quality degradation throught the elimination of grass flats which stabilize sediments and increase dissolved oxygen to the immediate area. Recommendation with justification concerning application. Include references to statute, administrative rule, etc. I would recommend denial of this project stating 17-3.02 and 17-3.05. Zoned GU. INTORDUCTION This application is to be reviewed by the Board of County Commissioners in accordance with Chapter 19-111 (a) (5) of the Monroe County Code. DISCUSSION: Applicant proposes to reclaim an area approximately 1650 feet long and varying in width from 0 to 100 feet that was reportedly eroded away by two + hurricanes (Betsy and Donna). The amount of fill required would be 10,500- cubic yard,all of which would be placed below the MHW line out to a line of existing rip -rap. Also proposed is the placement of additional rip -rap at this existing structure. The submerged area to be filled consists of dense beds of seagrass (Thalassia and Halidule) and a myriad collection of animals making for a very biologically productive bottom (see DER report). This has apparently re- sulted because of the protection afforded by the rip -rap from waves. EVALUATION: The major environmental concern is the loss of the seagrass and its associated animal life. Ordinarily this amount of destruction should be avoided, however, it is recognized that there may be legal precedence re- garding reclaimation of eroded land. In any event, even if the applicants were required to stabilize their existing shoreline they would probably want to use the rip -rap already present. Removing this rip -rap would result in the loss of its use as a protective barrier and thereby allowing possible impacts to the seagrass bed from wave action. RECOMMENDATION: Approval with the following conditions: 1. Filter fabric to be Placed in bet-e en the rip -rap boulders to control and prevent erosion. 2. Project construction may result in increased rates of eutro- phication in nearby bodies of waters. 2. Project construction may reduce the capacity of receiving bodica of water for shellfish }propagation or for recreational or commercial harvesting of shellfish. y 3. Project construction may reduce the capability of habitat to support a well balanced fish and wildlife population. X Project construction may interfere with the ability of habitat to support successful fish and wildlife propagation. 5. Project construction may impair the management or feasibility of management of fish and wildlife resources. X 6. Project construction may result in degradation of local water quality by reducing or eliminating the capacity of wetland vegetation for filtration and/or for nutrient stabilization or transformation. 7. Discharged substances attributable to the project may settle to form putrescent or otherwise objectionable sludge deposits. 8. Floating debris, oil scum, and other floating materials, attributable'to the project may be in amounts sufficient to be unsightly or deleterious. X 9. Materials discharged from the project may be in such degrees to create a nuisance. X 10. Discharge substances attributable to the project may be in such concentrations or combinations which may be toxic or harmful to humans, animals, or plant life. 11. Chlorides.°may exceed 250 mg/1 in bodies of freshwater. 12. Chlorides may exceed 250 mg/1 in groundwater due to reduced amounts of percolation because of increased surface runoff rates. 13. Chlorides will be increased more than 10% above normal in waters of a brackish or saline nature. 14. Copper residues may exceed 0.5 mg/l. 15. Zinc residues may exceed 1.0 mg/l. 16. Chromium residues may exceed 0.50 mg/l hexavalent or 1.0 mg/1 total chromium in effluent -discharge or may exceed 0.05 mg/1 after reasonable mixing in the receiving waters. 17. Phenolic type compounds calculated or reported as prsnol may exceed 0.001 mg/l. 18. Lead may exceed 0.05 m9/1. 19. Iron may exceed 0.30 mg/l. 20. Arsenic may exceed 0•.05 mg/l. 21. Oils and greases may exceed 15 mg/l or visible oil, defined as iridescense, may be present to cause taste and odors, or may interfere with other beneficial uses. X 22. Biological oxygen demand may exceed values which would cause dissolved oxygen to be depressed below 5 ppm or biologi- cal oxygen demand will be great enough to produce nuisance conditions. 25. Dissolved solids may exceed 500 mg/l as a monthly average or exceed 1000 mg/l at any time. 26. Specific conductance may be increased more than 100% above background levels or exceed 500 micromhos/cm for fresh water streams. 27. Cyanide or cyanates may be detectable in receiving bodies of water. 28. The pH receiving -waters may be caused to vary more than one unit above or below normal pH of the waters, or: 29. Lower pH value may be less than 6.0 30. Upper pH value will be more than 8.5 31. Detergent levels in receiving bodies of water may exceed 0.5 mg/l �32. Mercury may be detectable in receiving bodies of water. 33.. Coliform counts may exceed criteria established under Chapter 17-3, Florida Statutes, for the existing water classification in the project area. If certification is approved or waived, PL92-500 requires that effluent limitations be specified as part of the certification. When applicable, please specify: 1. Monitoring required by the applicant (include frequency) NOT APPLICABLE. 2. Effluent limitations (i.e., those limitations established under 17.3 for particular water classifications as well as water quality standards.) Include specifics. NOT APPLICABLE, NOT APPROVED.
