WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MnNROE CrUMTY,
FLORIDA, has received an application from Gene Gardner

WHEREAS, in compliance with State Statute, it is necessary
as part of the permitting procedure to read the following Biological
Assessment into the Record, as follows:
The apnlicant is oroposing the construction of 1001 x 5' concrete
seawall along an artificially created canal and a 135' long
riprap seawall alonq a natural shoreline to provide stabilization
and private boat mooring on the applicant1s residential lot.
Approximately three cubic yards of 10 inch diameter riprap will
be placed at the toe of the seawall along the length of the seawall,
excepting a ten foot long length of the seawall to be used for the
nlacement of boat davits. Placement of the riprap along the ooen-
water shoreline would be contained to the MLW line and above.
Seawall construction and its associated riprap will extend water-
ward to the edge of t~e canal dropoff, past MLW.
The applicant proposes to leave a 5' wide width between the off-
shore perimeter channel drop off and the waterward extent of the
riprap on the open water shoreline. The riprap will have a width
of seven feet. Backfill (four feet wide) will be placed landward
of the riprap.
All construction for the concrete and riprap seawalls will be done
by and \'Jith the aid of a backhoe. '
The project site is located within the Sugarloaf Shores Subdivision
of Sugarloaf Key. This area has been developed for residential
homesites arid is bordered along its entire perimeter by a deep
channel which connects a network of inland residential canal . The
entire area is approximately 10-30 percent developed. Most homesites
have been seawalled along their shorelines.
This entire area of uplands was most likely created from submergent
and/or wetland areas by spoiling the dredge material from the canals
and channels that now exist. The waters of Lower Sugarloaf Sound,
which are encountered offshore from the applicant's property, are
shallow (_I' to -21 MLW)~ \'1ith patchy seagrass and algae communities.
Lower Sugarloaf Sound is, in general, a large, shallow expanse of
semi-impo nded water with fair to good water ~uality and occasion-
ally high turbidity levels (during,windy periods which agitate the
relatively fine-textured sediments found throughout).
More specific to the applicant's pronerty, the adjacent open water
lot has been partially riprapped and partially left natural (some
sand brought in for a beach). The lot across the canal from the
arolicant's property has been vertically sea~alled.
The applicant's uoland property has been recently built upon
(stilt house). The shoreline is encountered at the erosion line
where a li~ht growth of buttonwood (Conocarpus erecta) and
Australian pines (Casuarina equisifirolia) is found.
This lot is bordered on two sides by water (canal side and open
water side). The littoral shelf along the open water shoreline
apoeared to be about 10 feet wide and the canal shelf appeared
to be about 2-4 feet wide. Substrate composition within the
littoral zone was loose limerock rubble. Several larger boulders
were observed in submeraent waters alonq the open water shoreline.

Dear Mr. Gardner:
As we advised you on July 14, 1981 , your application is
incomplete without local approval, purrlant to Section 253.124,
Florida Statutes, for filling waterwarc of the existing mean/
ordinary high water line.
Please submit the enclosed copy of our biological comments
together with your permit application to the Board of County
Commissioners/City Councilor their authorized permitting
authority. Section 253.124, Florida Statutes, states that the
county commission/city council ". . .shall have in hand the
(biological) report and findings thereof." It further states,
"The report shall be read into the record and duly considered
at the same meeting at which the board of county commissioners
or other authorized body takes final action on the application
for permit."
You will need to obtain a copy of the minutes of the meeting
or an appropriate indication of the local approval. This
letter, resolution or cory of the minutes should be sent to
this office. Your application will remain incomplete without

appeared to be about 10 feet wide and the canal shelf appeared
to be about 2-4 feet wide. Substrate composition within the
littoral zone was loose limerock rubble. Several larger boulders
were observed in submergent waters along the open water shoreline.
Also found along the open water shoreline (below the MLW line)
were sponges, hard corals (Porites sp.) turtlegrass (Thalassia
testudinum with patchy to dense occurrence), and algaes (Batophora sp.
and Acanthophora sp.).
The canal shelf was similar in nature to the open water shoreline,
on a smaller, less productive and less diverse scale. Turtlegrass
here is extremely patchy with scattered green algaes (Batophora
sp. and Halimeda sp.), dCJmi!.lating..
The only fish observed during the on-site inspection were mojarra.
D. No adverse impacts are anticipated from this project as it is
proposed. A very small amount .of seagrass and algae will be .
eliminated along the canal side, however, this will be minimal and
the riprap that is proposed for its replacement should produce a
credible alternative. Due to the high productivity of the littoral
shelf just offshore from the proposed riprap, placement of any
riprap outside of the MLW line could have an adverse impact.
