WHEREAS, the designation of the Florida Keys Area of Critical Concern was adopted
by the Administration Commission in 1975 and the Florida Legislature provided statutory
designation of the area in 1979; and
WHEREAS, the Florida Keys Protection Act ~380.0552(4), Florida Statutes,
contemplates removal of the Florida Keys Area designation after July 15, 1990, once the Act's
objectives have been met, particularly the adoption and implementation of comprehensive plans
and Land Development Regulations ("LDRs"); and
WHEREAS, Monroe County's Comprehensive Plan and LDRs were found to be in
compliance with the applicable Principles for Guiding Development and have been in effect since
September 15, 1986; and
WHEREAS, on April 15, 1993, Monroe County adopted, and subsequently transmitted
a new Comprehensive Plan in compliance with the Principles for Guiding Development set forth
in the Act, and is in the process of adopting new LDRs to implement the Goals, Objectives and
Policies of that plan; and
WHEREAS, Monroe County's Growth Management Division has demonstrated its
competence and ability to administer the LDRs without need of State of Florida, Department of
Community Affairs ("DCA ") supervision; and
WHEREAS, the cost and delay associated with DCA review of Monroe County
development codes and land use ordinances is unnecessary and unwarranted; and
WHEREAS, the Act requires establishment of a Florida Keys Area Resource Planning
and Management Committee (lithe Committee") with authority to act in a review and advisory
capacity;
NOW THEREFORE, the Board of County Commissioners of Monroe County hereby
resolves as follows:
1. The Governor of the State of Florida is respectfully requested to fill such
vacancies as may exist on the Committee immediately;
2. The Committee should be convened to develop recommendations concerning the
sufficiency of the Florida Keys Area's comprehensive plan and LDRs, as provided in Section
6(b) of the Act;
3. The foregoing actions should be taken to facilitate the expeditious removal of the
Florida Keys Area of Critical State Concern by rule or legislation.

Florida, at a regular meeting of said Board held on the 4th day of
