Resolution 348-1981 ~ RESOLUTI ON NO. 348 -1981 WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from ROLAND LIZ and, WHEREAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows: The applicant proposes the construction of a 26' long concrete seawall and the placement of riprap to either side to provide a base for boat davits and to prevent land erosion, respectively. The concrete seawall would be constructed waterward of MLH .. to the edge of the offshore perimeter channel. The length of this seawall section would be 26 feet, with a width of 8 feet. Seven cubic yards of fill would be placed landward of r1HW for the seawall. with 18 cubic placed waterward. Construction of the seawall would consist of concrete block laid on top of concrete footing and nlastered over. The riprap placed south of the proposed conrete seawall would extend no further waterward than the ~1LW line. The width of this riprap line would be five feet. The length of this riprap section would be 60 feet. The riprap placed north of the proposed concrete seawall would extend to within one foot of the edge of the offshore perimeter channel. Filter cloth would be used behind the riprap where backfill would be placed. Riprap to either side of the seawall would be aoproximately two feet in diameter. The total amount of riprap to be placed would be approximately 33 cubic yards waterward of MHW, and 15 cubic yards landward of MHW. The project site is located within the Sugarloaf Shores subdivision of ~ugarloaf Key, This area has been developed for residential homesites and is bordered along its entire perimeter by a deep channel which connects a network of inland residential canals. The entire area is approximately 10-30 percent developed. Most homesites have been seawalled along their shorelines. The entire area of uplands was most likely created from submergent and/or wet- land areas by spoiling the dredge material from the canals and channels that now exist, The waters of Lower Sugarloaf Sound, which are encountered offshore from the aDplicants's property, are shallow (..I" to -2" MU!), \A/ith patchy sea- grass and algal communities. Lower Sugarloaf Sound is, in general a large, sha 11 0\11 expans-e of semi ..impounded water with fai r to good water qua 1 ity and occasionally high turbidity levels (during windy oeriods which agitate the rela.. tively fine-textured sediments found throughout). More specific to the applicant's property, two seawalls have been constructed; one'on adjacent lot 24 and another several lots to the south. These seawalls were constructed out to the peripheral channel dropoff. No records of any recent permits were located for these seawalls. The applicant's property is primarily upland. It is presently undeveloped and exhibits a 100' long shoreline which has eroded very little as judged from the narrow intertidal zone and the established submergent marine community that is found just waterward of the shoreline escarpment line. This shoreline, from the upland escarpment line down to the MLW line, exhibits a loose limerock rubble substrate with little of no wetland veqetation. Some buttonwood (Conocarpus erecta) are found just upland from where the property drops vertically to the intertidal area (escarpment line). Resol uti on Rolando Liz Page Two The most bioloigcally significant area within the project site is found from the approximate MLW line to the offshore channel drip. Turtlegrass (Thalassia testutinum) if found along the entire stretch of the project site, with growth ranging from patchy to dense. Additional but lesser amounts of green algaes were also observed, including Halimeda sp., Batophora sp., and Acetabularia sp.. Numerous sessile filter-feeders were common along the submergent shelf of this site and included anemones, sponges, and hard corals (Porites porites). Fish species here included mojarra, killifish (Cyprinodon sp.), and mangrove snapper (Lutjanus riseus). During the on-site inspection, a little blue heron(Florida caerulea was observed feeding along the shoreline. The submergent shelf below the MLW line is approximately 5" -7" wide. The off- shore channel into which the shelf drops is approximately 60' -901 wide. The primary impact of concern is the elimination through filling of an offshore submergent marine community. This loss has been reduced by the applicant by 75 percent (from the original application and will now be approximately 100 square feet. To offset this loss, additional habitat would be created along the 75 feet of shoreline to be riprapped. The newly created riprap would stabilize this shoreline and provide habitat for crustaceans, gastropods, and, in the case of the permanently submergent riprap, algaes, sponges and fish. Pursuant to Chapter 253 and 403 of the Florida Statutes and Chapters 17-3 and 17-4 of the Florida Administrative Code, I would now recommend the approval of this project. The following conditions are suggested as part of any permit issuance: 1. Backfilling should be done after the installation of the riprap and filter cloth. If this is not possible, turbidity curtains should be utilized during all filling operations. 2. The riprap to the south of the concrete seawall shall not ext~nd further waterward than the submergent vegetation line. INTRODUCTION: This project is to be rev~ewed by the Monroe County Board of Commissioners in accordance with Chapter 19-1ll(a) (5) of the County Code. DISCUSSION: Applicant proposes to construct a 100 linear ft. seawall along his waterfront property abutting Lower Sugarloaf Sound. Seventy-five (75) ft. of the seawall will be composed of rip-rap boulders placed along the }~W line; a 26 ft. long vertical, , concrete section will complete the seawall. This latter section of the seawall will extend out beyond the ML'~ line to the landward edge of the peripheral channel and will support boat davits. According to the Dept. of Environ. Reg. report, approximately 33 c.y. of rip-rap will be required waterward of MEW and another 15 c.y. landward of MEW. In places where backfilling will be required, ,filter fabric will be used. A discussion of the biota present and a description of the area to be impacted is provided. in the attached Dept. Environ. Reg. report. LIZ, ROLANDO ir44-44797-5E Monroe County - Sugar10af Key Page Two A, The applicant proposes the construction of a 26' long concrete seawall and the placement of riprap to either side to provide a base for boat davits and to prevent land erosion, respectively. The concrete seawall would be constructed waterward of MLW - to the edge of the offshore perimeter channel. The length of this seawall section would be 26 feet, with a width of 8 feet. Seven cubic yards of fill would be placed landward of MEW for the seawall, with 18 cubic yards placed waterward. Construction of the seawall would consist of concrete block laid on top of concrete footing and plastered over. Tl'Je riprap placed south of the proposed concrete seawall would extend no further waterward than the MLW line. The width of this riprap line would be five feet. The length of this riprap section would be 60 feet. The riprap placed north of the proposed concrete seawall would extend to within one foot of the edge of the offshore perimeter channel. Filter cloth would be used behind the riprap where backfill would be placed. Riprap to either side of the seawall would be approximately two feet in diameter. The total amount of riprap to be placed would be approximate11 33 cubic yards water- ward of MHW and 15 cubic yards landward of MHW. B. The project site is located within the Sugarloaf Shores subdivi- sion of Sugarloaf Key. This area has been developed for resi= dential homesites and is bordered along its entire perimeter by a deep channel which connects a network of inland residential canals. The entire area is approximately 10-30 percent developed. Most homesites have been seawa11ed along their shorelines. This entire area of uplands was most likely created from submergent. and/or wetland areas by spoiling the dredge material from the canal~ and channels that now exist. The waters of Lower Sugarloaf Sound, which are encountered offshore from the applicant's property, are shallow (-1' to -2' }~W), with patchy seagrass and algal cOmD1unities. Lower Sugarloaf Sound is, in general, a large, shallow expanse of semi-impounded water with fair to good water quality and occasionall~ high turbidity levels (during windy periods which agitate the relatively fine-textured sediments found throughout). llore specific to the applicant's property, two seawalls have been constructed; one on adjacent lot 24 and another several lots to the south. These seawalls \-Jere constructed out to the peripheral ~ (1) LIZ, ROLANDO 1144-44797 - 5E Monroe County - Sugarloaf Key Page Three channel dropoff. No records of any recent permits were located for these seawalls. C. The applicant's property is primarily upland. It is presently undeveloped and exhibits a 100' long shoreline which has eroded very little as judged from the narrow intertidal zone and the established submergent marine community that is found just water- ward of the shoreline escarpment line. . . This shoreline, from the upland escarpment line down to the MLW line, exhibits a loose limerock rubble substrate with little or no wetland vegetation. Some buttonwoods (Conocarpus erecta) are found just upland from where the property drops vertically to the intertidal area (escarpment line). The most biologically significant area within the project Site is found from the approximate MLW line to the offshore channel drop. Turtlegrass (Thalassia testudinum) is found along the entire stretch of the project site, with growth ranging from patchy to dense. Additional but lesser amounts of green algaes were also observed, including Halimeda sp., Batophora sp., and Acetabularia sp. . ~ Numerous sessile filter-feeders were common along the submergent shelf of this site and included anemones, sponges, and hard corals (Porites porites). Fish species here included mojarra, killifish (Cyprinodon sp.), and mangrove snapper (Lutjanus griseus). During the on-site inspection, a little blue heron (Florida faerulea) was observe~ feeding along the shoreline. The submergent shelf below the MLW line is approximately 5 '. -7 I wide. The offshore channel into which the shelf drops is approximately 60'-90' wide. D. The primary impact of concern is the elimination through filling of an offshore submergent marine community. This loss has been re- duced by the applicant by 75 percent (from the original application) and will now be approximately 100 square feet. To offset this loss, additional habitat would be created alo~g the 75 feet of shoreline to be riprapped. The newly created riprap would stabilize this shoreline and provide habitat for crustaceans, gastropods, and, in the case of the permanently submergent riprap, algaes, sponges and fish. /-- f~ e <, . ; LIZ, ROLANDO 4f44-44797-5E Monroe County - Sugarloaf Key Page Four E. Pursuant to Chapters 253 and 403 of the Florida Statutes and Chapters 17-3 and 17-4 of the Florida Administrative Code, I would now reconunend the approval of this project. The following conditions are suggested as part of any permit issuance: 1. Backfilling should be done after the installation of the rip- rap and filter cloth. If this is not possible, turbidity curtains should be utilized 'during all filling operations. 2.
