A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS REQUESTING THAT THE
SOUTH FLORIDA MANAGEMENT DISTRICT, ARMY CORPS
OF ENGINEERS, STATE OF FLORIDA DEPARTMENT OF
ENVIRONMENTAL REGULATION WORK TOGETHER TO
RESTORE FRESH WATER FLOW AND NATURAL
HYDROPERIODS TO FLORIDA BA Y, INCLUDING
ESTABLISHMENT OF MINIMUM FLOWS AND LEVELS FOR
TAYLOR SLOUGH, SHARK RIVER AND OTHER
TRIBUTARIES OF FLORIDA BAY, ACQUISITION OF THE
FROG POND AREA TO RESTORE FRESH WATER FLOW TO
THE HEADWATERS OF TAYLOR SLOUGH, ENDORSING
THE RECOMMENDATIONS OF THE NATURAL PARK
SERVICE CONCERNING WATER MANAGEMENT IN
TA YLOR SLOUGH AND EFFECTS IN FLORIDA BAY,
ADDRESSING THE INTERESTS OF FLORIDA BAY IN
PERMITTING DECISIONS, INCLUDING THE DER PE~IT

WHEREAS, the Monroe County Board of County Commissioners finds that it is in the
public interest and to the benefit of the residents of Monroe County to restore fresh water flow
and natural hydroperiods to Florida Bay, and
WHEREAS, the Monroe County Board of County Commissioners recognizes that water
quantity and water quality are important to maintaining the Everglades and Florida Bay
ecosystem, and
WHEREAS, the lack jf fresh water flow to Florida Bay was recognized by the Lower
East Coast Regional Water Supply Plan Advisory Committee's recommendation to the South
Florida Water Management District Governing Board to immediately take all possible actions
to restore historic fresh water flows to eastern Florida Bay, and
NOW THEREFORE, be it resolved that the Monroe County Board of County
Commissioners hereby requests that the South Florida Water Management District, the United
States Army Corps of Engineers, and the State of Florida Department of Environmental
Regulation work together immediately to restore fresh water flow and natural hydroperiods to
Florida Bay, and ensure that this water meets numerical water quality standards for phosphorous
and nitrogen concentrations and ratios necessary to prevent imbalance in the Florida Bay
ecosystem, without the necessity of litigation, and request immediate actions to:
1. Establish minimum flows and minimum levels which reflect seasonal variations
for Taylor Slough, Shark River and other tributaries of Florida Bay to prevent significant harm
to the water resources and ecology of Florida Bay using the best information available at this
time pursuant to Florida Statute ~373.042;
2. Seek public and private funding sources for acquisition of the Frog Pond area in
order to manage the Frog Pond for restoration of fresh water flow to the headwaters of Taylor
Slough without the need to drain water from the area to support agriculture. In addition,
conduct or require adequate mitigation for the loss of wetlands and damage to Florida Bay which
has resulted from management of the Frog Pond area for agricultural use;
3. Implement the recommendations of the National Park Service, South Florida
Research Center, Everglades National Park concerning "Water Management in Taylor Slough
and Effects in Florida Bay" as presented to the Army Corps of Engineers and the South Florida
Management District at the April 26, 1993 public meeting on the Taylor Slough Demonstration
Project;
4. Ensure that delivery of adequate quantities of fresh water and restoration of
natural hydroperiods to Florida Bay are included in agency permitting decisions, including the
State of Florida, Department of Environmental Regulation permit to the South Florida Water
Management District issued pursuant to Florida Statutes ~373.4592(6) (The Everglades
Protection Act), and Chapter 403; and
5. Ensure that water delivered to Florida Bay meets numerical water quality
standards for phosphorous and nitrogen concentrations and ratios necessary to prevent imbalance
in the Florida Bay ecosystem;
6. Implement or amend the State Water Policy adopted pursuant to Florida Statutes
~373.026 and ~403.061 to reflect the need for delivery of adequate quantities of fresh water and
restoration of natural hydroperiods to Florida Bay and ensure that this water meets numerical
water quality standards for phosphorous and nitrogen concentrations and ratios necessary to
prevent imbalance in the Florida Bay ecosystem.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the 25th day of May, 1993.
