Resolution 106-1961 RESOLUTION NO,l06 -1961 WHEREAS, the Board of County Commissioners of Monroe Coun- ty, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described street, alley-way, road or highway as delineated on the hereinafter described plat or map, and WHEREAS, under Chapter 336, Florida Statutes 1955, it is ne- cessary to hold a public hearing after publishing due notice of said hearing in accordance with said Chapter, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION- ERS OF MONROE COUNTY, FLORIDA, that at 8:00 P. M. on Tuesday, January 2, 1962, said Board will hold a public hearing to determine whe- ther o'r not said Board will renounce and disclaim any right of the Coun- ty and the public in and to the following described street, alley-way, road or highway: On Grassy Key, Monroe County, Florida and is that portion of OCEAN VIEW DRIVE which lies southeasterly of and adjacent to Lots 1-2 -3 inclusive, Block 36, accor- ding to the Plat of Crains Subdivision recorded in Plat Book 1, at page 51 of Monroe County Official Records. BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of said Board be, and he is hereby ordered to publish notice of said meeting in accordance with the provisions of Chapter 336, Florida Statutes 1955. (SEAL) ~. - 613 Caroline street Key West, Florida December 4, 1961 The Honorable, The County Commissioners, Monroe County, Key West, Florida Gentlemen: I am the owner of Lots 1-2-3, Block 36, Crains Sub- division, Graasy Key, Florida. This Subdivision is recorded in Plat Book 1 at page 51 of the County Official Records dated June 22, 1908. For sometime I have tried to purchase Bay Bottom riparian to the above lots from the Trustees of the Internal Improvement Fund. I have not been sucessful because the Trustees maintain that inasmuch as Ocean View Drive is a dedicated road, then the County is the riparian owner. There is attached a plat of survey of Block 36, Crains Subdivision. This plat was made by Florida Keys Engineering, Inc.. Please note that the existing shore line lies well to the northwest of the platted location of Ocean View Drive. It is a matter of common knowledge that there has been considerable errosion in this area for several years. In view of the above, I should like to request that, 1. All of Ocean View Drive which lies on the seaward side of Block 36 be vacated, or t. 2. That portion of Ocean View Drive that lies \ to the seaward of Lots 1-2-3 be vacated.
