RESOLUTION NO. 110_1961
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, at a regular meeting held on December 12, 1961, heard an appeal
requesting said Board to reverse the decision of the Monroe County Zoning
Board, which said Zoning Board, at a public hearing held on September 29,
1961, granted the request of Theodore G. Smallwood for a change of zoning
on Part of Lot 2, in Section 5, Twp. 62 S., Rge. 39 E., Key Largo, Monroe
County, Florida, from Classification RU-I to BU-2, as defined in the Mon-
roe County Zoning Regulations, and
WHEREAS, said Board of County Commissioners, upon said appeal
considered at said meeting held December 12, 1961, passed a Resolution re-
versing the decision of the Monroe County Zoning Board, and
WHEREAS, after the passage of said Resolution the said Theodore G.
Smallwood filed a petition with said Board of County Commissioners for a
review of their action, in accordance with the laws and regulations applicable
thereto, and
WHEREAS, after consideration of said petition for review, and after
reviewing the record and hearing the testimony of the said Theodore G. Small-
wood, a majority of the members present voted to rescind the Resolution
adopted at said meeting held December 12, 1961, and thereby uphold the de-
cision of the Monroe County Zoning Board concerning the aforesaid change
of zoning, and
WHEREAS, it is necessary to pass a Resolution rescinding the Resolu-
tion previously passed, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Resolution of the Board of County
Commissioners, passed at a regular meeting held December 12, 1961, re-
versing the decision of the Monroe County Zoning Board made at its public
hearing held September 29, 1961, granting the request of Theodore G. Small-
wood for a change of zoning on Part of Lot 2, in Section 5, Twp. 62 S., Rge. 39 E.,
Key Largo, Monroe County, Florida, from Classification RU-l to BU-2,
as defined in the Monroe County Zoning Regulations, be, and the same is
hereby rescinded, and of no force and effect, and the decision of the Mon-
roe County Zoning Board concerning said change of zoning be, and the same
is hereby affirmed.
