RESOLUTION NO. III -1961
WHEREAS, the Zoning Board of Monroe County, Florida, at a public
hearing on October 27, 1961, duly called and held in accordance with the
zoning regulations of Monroe County, Florida and the laws of the State of
Florida, considered the request of Scharf Land Development Company for
a change in zoning on Lots 1 through 5, Block 4, Lots 1 through 4, Block 5,
Lots 1 through 4, Block 6, and Lots 1 through 6, Block 7, of The Palms
Plat No.2, Marathon, Monroe County, Florida, from Classification RU-l
to RU -4, as defined in the Monroe County Zoning Regulations, and for a
change in zoning on Lots 5 through 11, Block 1, Lots 1 through 7, Block 2,
and Lots 3 through 9, Block 3, of The Palms Subdivision, Marathon, Monroe
County, Florida, from Classification R U -1 to RU -4, as defined in the Mon-
roe County Zoning Regulations, and
WHEREAS, after taking testimony for and against said request, said
Board denied said request, and
WHEREAS, an appeal has been filed with the Board of County Commis-
sioners of Monroe County, Florida, in accordance with the laws applicable
thereto, asking said Board to reverse the decision of the Monroe County Zon-
Ing Board, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida heard such appeal, and after reviewing the record and proceedings
and action taken at said public hearing held October 27, 1961, by the Zoning
Board of Monroe County, Florida, and after taking te stimony for and against
the action requested in said appeal, by a majority vote of the members present
reversed the decision of said Zoning Board, and
WHEREAS, it is necessary to pass a Resolution reversing the decision
of said Zoning Board, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the decision of the Monroe County Zoning
Board, made at its public hearing held on October 27, 1961, denying the re-
quest of Scharf Land Development Company for a change in zoning on Lots
1 through 5, Block 4, Lots 1 through 4, Block 5, Lots 1 through 4, Block
6, and Lots 1 through 6, Block 7, of The Palms Plat No.2, Marathon,
Monroe County, Florida, from Classification RU-l to RU-4, as defined
in the Monroe County Zoning Regulations, and for a change in zoning on
Lots 5 through 11, Block 1, Lots 1 through 7, Block 2, and Lots 3 through
9, Block 3, of The Palms Subdivision, Marathon, Monroe County, Florida,
from Classification RU -1 to RU -4, as defined in the Monroe County Zoning
Regulations, be, and the same is hereby reversed, and the said request
for change of zoning as aforesaid is hereby granted.
