Resolution 011-1963 RESOLUTION NO. 11 -1963 WHEREAS, Benjamin Weinstein, through his agent, Harold Stevens, and Carbonell, Inc., have petitioned the Board of County Commissioners of Monroe County, Florida to vacate a 10 foot alley situate in Block 49 on the Island of Key West, according to the Key West Realty Company's First Subdivision of Tract 21 and Lots 1, 2, 3, 4 and 5, as hereinafter described, and WHEREAS, the said Benjamin Weinstein, through his agent, Harold Stevens, and Carbonell, Inc., have duly published notice of their intention to apply to said Board of County Commissioners for vacation of said alley, and WHEREAS, The City of Key West, Florida has duly passed a Resolu- tion vacating said alley, and WHEREAS, the said Benjamin Weinstein, through his agent, Harold Stevens, and Carbonell, Inc., have furnished said Board of County Commis- sioners with Proof of Publication of their intention to vacate said alley, to- gether with certificate showing that all State and County Taxes, including the current year, have been paid on lands owned by the said Benjamin Weinstein and Carbonell, Inc., abutting on said alley sought to be vacated, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the following 10 foot alley, more particu- larly described as follows: A 10 foot alley depicted upon Block 49 of Key West Realty Company1s First Subdivision of Tract 21 and Lots 1,2, 3, 4 and 5, according to a plat thereof recorded in Plat Book 1, page 43, of the Public Records of Monroe County, Florida; be, and the same is hereby vacated and returned to acreage, subject, however, to a 10 foot utility easement with the right of ingress and egress for motor vehicles to install and maintain same.
