RESOLUTION NO.

WHEREAS, the Board of County Commissioners of Monroe County,
Florida, at a meeting held September 29, 1961, adopted Resolution No.
83-1961, reversing the decision of the Zoning Board of Monroe County,
Florida denying the request of Benjamin Bernstein, Miriam Bernstein,
his wife, and F. E. B. Corporation for a change in zoning on a proposed
plat of LINCOLN MANOR EST AT ES from Clas sification B U -1 to R U -1,
as defined in the Monroe County Zoning Regulations, and granted to the
said Benjamin Bernstein, Miriam Bernstein, his wife, and F. E. B. Cor-
poration a change in zoning on said proposed plat of LINCOLN MANOR
ESTATES from Classification BU-l to RU-l, as defined in the Monroe
County Zoning Regulations, and
WHEREAS, prior to the adoption of said Resolution, said Board of
County Commissioners passed a motion on September 5, 1961, that action
on the aforesaid request be held in abeyance until full membership of the
Board of County Commissioners was present, and
. WHEREAS, on September 29, 1961, the full membership of said
Board of County Commissioners was not present, and
WHEREAS, in the matter of Jesse Slone and Bertha M. Slone, et al. ,
Plaintiffs, vs. Gerald Saunders, Harry Harris, William A. Freeman, Jr.,
William Osterhoudt and Hilario (Charley) Ramos, Jr., as and constituting
the Board of County Commissioners of Monroe County, Florida, et al.,
Defendants, filed in the Circuit Court of the 16th Judicial Circuit of Florida,
in and for Monroe County, being Chancery Case No. 17-164, the Court en-
tered a Final Decree on September 20, 1962, indicating that the action of
said Board of County Commissioners taken in Resolution No. 83-1961 as
aforesaid was not valid, and directed said Board of County Commissioners
to either grant or deny the request of the said Benjamin Bernstein and F. E. B.
Corporation for change of zoning as aforesaid, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, that the action taken by said Board of
County Commissioners in Resolution No. 83 -1961, reversing the decision
of the Zoning Board of Monroe County, Florida denying the request of
Benjamin Bernstein, Miriam Bernstein, his wife, and F. E. B. Corporation
for a change in zoning on a proposed plat of LINCOLN MANOR ESTATES
from Classification BU-l to RU-I, as defined in the Monroe County Zon-
ing Regulations, and granting to the said Benjamin Bernstein, Miriam
Bernstein, his wife, and F. E. B. Corporation a change in zoning on said
proposed plat of LINCOLN MANOR ESTATES from Classification BU-l
to RU-l, as defined in the Monroe County Zoning Regulations, be, and
the same is hereby re-adopted and confirmed.
