Resolution 021-1963 RESOLUTION NO. 21-1963 WHEREAS, the Board of County Commissioners of Monroe County, Florida has previously deeded certain lands to the State of Florida for the use and benefit of the State Road Department of Florida, and WHEREAS, through inadvertence the lands intended to be conveyed were erroneously described, and lands other than those intended to be con- veyed were actually conveyed to the said State of Florida for the use and benefit of said State Road Department, and WHEREAS, the State of Florida desires to transfer back to Monroe County, Florida, the lands previously deeded in error, in exchange for the lands originally intended to be deeded to said State of Florida, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the following described lands, to-wit: A parcel of land in Government Lot 3, Section 10, Town- ship 66 South, Range 32 East, more particularly described as follows: Commencing at the intersection of the East line of said Government Lot 3 with the centerline of State Road 5 (Centerline of Old F. E. C. Railway Right of Way), run S. 74020' W. along said centerline a distance of 2187.55 feet; thence N. 15040' W. a distance of 750 feet, more or less, to the Shoreline of the Bay of Florida, designated as point IIA "; thence from said POINT OF BEGINNING, run N. 74020' E. a distance of 197.69 feet along the Northerly right of way line of State Road 5; thence N. 15040' W. a distance of 820 feet, more or less, along the Westerly boundary of Marathon Beach, according to the plat as re- corded in Plat Book 2, Page 16 of the Public Records of Monroe County, to the Shoreline of the Bay of Florida,desig- nated as point liB "; thence meander said shoreline from point liB" to point "A" in a Southwesterly direction a distance of 250 feet, more or less, containing 3.6 acres, more or less; be deeded to the State of Florida for the use and benefit of the State Road De- partment of Florida. BE IT FURTHER RESOLVED BY SAID BOARD that the Chairman and the Clerk of said Board be, and they are hereby authorized and directed to execute the necessary Deed to convey the above described lands to said State of Florida, upon receipt from the State of Florida of a Deed trans- ferring back to ;Monroe County the lands inadvertently deeded in error to the State of Florida for the use and benefit of the State Road Department of Florida, as set forth in the preamble of this Resolution.
