A RESOLUTION ADOPTING THE GOALS OF THE ORGANIBATION,g
JUSTICE IN TAXATION, DIRECTING STAFF TO JOIN WITH THE.b,;.
CITY OF KEY WEST AND THE MONROE COUNTY BOARD OF "'PUBLIC-
INSTRUCTION TO FUND AND SEEK LEGAL REDRESS IN FEDERAL
COURT FROM THE STATE OF FLORIDA AND THE GOVERNMENT OF
THE UNITED STATES OF AMERICA FOR THEIR DISCRIMINATORY
ACTIONS IN THE FUNDING OF PUBLIC SCHOOLS AND THE
APPROPRIATION OF COUNTY PROPERTY WITHOUT COMPENSATION
IN LIEU OF AD VALOREM TAXES.

WHEREAS, the residents of Monroe County and the City of Key
West bear the highest cost of living in the State of Florida; and
WHEREAS, the State of Florida proposes to contribute 14% of
the total FY 94 school district budget in Monroe County; and
WHEREAS, the State of Florida proposes to fund 60%, on
average, of the school board budgets in the remaining sixty-six
counties in the State of Florida; and
WHEREAS, the apportionment of public funds is discriminatory
to the citizens of Monroe County; and
WHEREAS, the State of Florida and the government of the
United States of America have appropriated 95.3% of the taxable
land of the County of Monroe; and
WHEREAS, no compensation has been paid to Monroe County for
the lost ad valorem taxes which would have accrued from these
properties; and
WHEREAS, the
organization, Justice
in Taxation,
has
requested the assistance of the Monroe County Board of County
Conunissioners and all other taxing authorities in Monroe County
to challenge these discriminatory actions of the state of Florida
and the government of the United states of America; and
WHEREAS, the citizens of Monroe County would achieve
significant tax relief if these discriminatory actions were
remedied; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1. The County Administrator, staff and attorney(s)
are directed to meet with the other taxing authorities in Monroe
County to discuss and formulate plans for initiating and funding
a suit in federal court to obtain relief for the citizens of
Monroe County from the discriminatory fiscal practices of the
State of Florida and the government of the united States of
America.
Section 2. The County Attorney is directed to report back
to the Board of County Commissioners at the earliest possible
date with a plan for actions to be taken to achieve justice in
taxation.
Section 3. This resolution shall go into effect
immediately upon its passage and adoption and authentication by
the signatures of the presiding officer and the Clerk of Courts.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 26th day of May , 1993.
