Resolution 003-1965 RESOLUTION NO. 3 -1965 WHEREAS, the Board of County Commissioners of Monroe County, Florida desires to set up rules and regulations governing annual leave and sick leave for all County employees, and WHEREAS, said Board previously adopted Resolution No. 108-1961, dated December 12, 1961, concerning sick leave for County employees, and now desires to cancel, annul, repeal and declare said Resolution void and of no force and effect, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY I FLORIDA, as follows: Section 1. That Resolution No. 108-1961, adopted by said Board on December 12, 1961, be, and the same is hereby cancelled, annulled, repealed, and declared to be of no force and effect. Section 2. That the following rules and regulations governing annual leave and sick leave for all County employees shall be adopted: A. ANNUAL LEAVE. (1) All County employees are entitled to annual leave with pay, based on years of creditable service. (2) County employees shall earn annual leave as follows: Length of Creditable Service Rate of Accrual Less than 3 years Over 3 years 2 weeks per year 3 weeks per year (3) Annual leave shall not be accumulated, and shall be credited to each employeels leave account at the beginning of the cal- endar year, and such leave shall be given during the calen- dar year. Leave not taken by an employee at his option shall be forfeited at the end of the calendar year; however, in cases where such leave was not given for reasons of emer- gency existing in the County, or other administrative rea- sons, then the Board may permit accumulation of such leave, not to exceed a total of 30 days. B. SICK LEAVE. (1) All County employees shall earn sick leave of 10 days during each calendar year. (2) Sick leave which is earned and not used during the year in which it is earned shall accumulate until there appears on the employee1s sick leave account a credit of 90 days, such credit to be available for use in succeeding years. (3) Sick leave may be granted to employees when it is necessary for them to be absent during their regular tour of duty for medical, dental or optical examination or treatment. Such absence shall be limited to the actual time required. (4) Sick leave shall be granted to an employee when a member of his immediate family is afflicted with a contagious dis- ease when through exposure to such disease the presence of the employee on duty would jeopardize the health of others. (NOTE: "Contagious disease" means a disease ruled as subject to quarantine or requiring isolation of the patient by the health authorities having jurisdiction). (5) Sick leave with pay may be granted when application therefor is made by the employee immediately upon his return to duty and such application is supported by a medical certificate or other acceptable evidence. Employees not complying with the provisions of this section shall have such absence charged to annual leave or leave without pay if no annual leave is credited. (6) A person absent on sick leave for a period of 90 days shall be dropped from the rolls without prejudice, If his illness is such that it will render him incapable of returning to duty. (7) Any employee of whom it shall be proved that he has abused his sick leave privileges shall be charged as a malingerer and forthwith dropped from the employ of the County. C. LEAVE WITHOUT PAY. (1) Leave of absence without pay may be granted to employees for urgent personal reasons, such leave not to exceed 30 days in any case during anyone calendar year. An employee shall not be permitted to start on such leave until formal approval has been given by the Board. Dated January 12th , 1965.
