Resolution 030-1966 RESOLUTION NO. 30-1966 WHEREAS, the Attorney General of the State of Florida, in an opinion dated March 18, 1966, addressed to Mr. Sidney Mattin, President of State Association of County Commissioners, Hawthorne, Florida, held that counties of the State of Florida are authorized to accept grants from agencies of the United States of America and to make comprehensive plans for the develop- ment of the counties, including the establislunent of water distribution sys- tems and waste disposal systems, and WHEREAS, Monroe County, Florida does not have available sufficient funds to undertake the comprehensive planning for area sewer develop ment, and WHEREAS, Monroe County, Florida intends to make application to the Farmers Home Administration, United States Department of Agriculture, for a grant for the purpose of making comprehensive area sewer development plan, and WHEREAS, Monroe County, Florida is an organization as defined in FHA Instruction 442.7 as eligible for a grant for planning, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That all actions heretofore taken by the Chairman and the Clerk of the Board of County Commissioners with respect to obtaining a grant for the purpose of making a comprehensive area sewer development plan are hereby ratified and confirmed and the Board of County Commissioners has determined that the County does not have sufficient funds available to undertake such planning. 2. That the Chairman and Clerk of the Board be, and they are hereby authorized and directed to execute on behalf of the County an agreement with Russell & Axon, Consulting Engineers, Inc., for the preparation of a compre- hensive area sewer development plan for the County (exclusive of municipalities having populations of 5, 500 or more) in the form attached hereto and made a part hereof. 3. That the Chairman and Clerk of the Board be, and they are hereby authorized and directed to execute on behalf of the County a Grant Agreement with the United States of America in the form prescribed therefor by the Far- mer s Home Administration, and to perform any and all other acts on behalf of Monroe County, Florida, necessary to the acceptance of a grant from the Farmers Home Administration for comprehensive planning for sewer systems. 4. That the scope and content of the said plan will meet the conditions specified in the agreement with Russell & Axon, Consulting Engineers, Inc., copy of which is attached hereto and made a part hereof. 5. That all Resolutions heretofore adopted in conflict herewith be, and the same are hereby rescinded. Dated June 28th, 1966.
