WHEREAS, the Board of County Commissioners of Monroe County,
Florida desires to amend the plat filing rules and regulations for Monroe
County, Florida, adopted by Resolution No. 36-1963, by adding a new
sub-section, to be known as sub-section (d), under sub-section 3 of
Section C, "General Procedure for Filing Plats", now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, that the Rules and Regulations for
Filing Plats and Developing Subdivisions in Monroe County, Florida be,
and the same are hereby amended by adding a new sub-section, to be
known as sub-section (d), under sub-section 3 of Section C, "General
Procedure for Filing Plats", as follows:
SECTION C. GENERAL PROCEDURE FOR FILING PLATS
3. Construction of the Work
(d) The Developer may, in lieu of posting a cash or perform-
ance bond, subject to the approval of the Board of County
Cornrnissioners of Monroe County, enter into an agreement
to convey to the County a tract of land as security for the
construction and paving of the streets within the proposed
subdivision. The tract of land shall be equivalent in value
to the estimated construction cost of the streets in the pro-
posed subdivision and the cost will be computed according
to the formula as stated in Section C, paragraph 3(a).
The Developer will deliver a Warranty Deed conveying said
tract to the County, to be held by the County under an agree-
ment as follows:
(1) If the Developer complies with its agreement to construct
and pave the streets within five (5) years of the date the
plat is recorded, the Warranty Deed will be returned to
the Developer.
(2) In case the Developer fails and refuses to construct and
pave the streets within five (5) years of the date the plat
is recorded, the County may cause the recording of the
Warranty Deed as damages for the Developer's failure
to construct and pave the streets.
(3) The Developer and the County will cause the agreement
to be recorded to give notice of the existence of the agree-
ment and that said tract of land is being held by the County
as security for the guarantee of the construction and pav-
ing of the streets, and prevent the sale of the tract of land
to any bona fide purchasers after said plat is recorded.
(4) Upon the Developer causing the construction and paving
of the streets to the satisfaction of the County, the County
will enter into an agreement for the purpose of disclosing
on record that the tract of land has been released by the
County.
