Resolution 308-1993 Planning Department RESOLUTION NO. 308 -1993 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 91, LOT 3 and 45, BLOCK 3, LIDA SUBDIVISION, VACA KEY, MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 51. WHEREAS, the property described as Lot 3 and 45, Block 3, Lida Subdivision, Vaca Key, Monroe County, Florida, is current- ly zoned Urban Residential Mobile Home (URM); and WHEREAS, the staff recommends approval of the boundary changes as indicated in Staff Recommendation by Tiffany Stankiewicz dated August 20, 1993; and ::; ~ WHEREAS, the current Land Use district bound~~e$ wh~ch ~di- '(""1 C/) rr-. N :::: \C were placed in error with the adoption of the Sep%ember ~5, 1986 o Land Development Regulations, and therefore the ~bseque~t maps -, were also in error, as they did not follow the previously demarcat- ed BU-1-L boundary; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1) The action of the Planning Director, which recommends approv- al of a boundary change in Land Use District Map Boundary Interpre- tation Number 91, dated August 23, 1993, is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Mon- roe County Code; and is therefore approved; and that 2) The above described property should have been originally designated as Suburban Commercial (SC) and not Urban Residential Mobile Home (URM) as currently indicated; and that 3) The above conclusion of law, is predicated upon the finding of facts and conclusions outlined in the staff recommendation which this Board hereby adopts as its own. 4) The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning Department. 5) The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Community Affairs. (RE: #00348170 - 000100; #00348170 - 000200; #00348170-000400) has been completed. Listed below are the recommended findings & Lots 1, 2, 3, & 45, 1, Twp . 6 6 , Rng . 3 3 , #00348170 - 000300; & conclusions. I SUMMARY OF INFORMATION AND DOCUMENTARY EVIDENCE (ATTACHED) Application by Barry Mankowitz A copy of the Land Use District Map, page 231. A copy of the Land Use District Map Proposed, page 231. A copy of the REDI Strip Maps, 24th Edition, 1989, page 151. A copy of the REDI Aerial Photo Map Atlas, 28th Edition, dated 1993, at a scale of 1" = 300', page 13-1. A copy of Monroe County Zoning Maps Pre-September 15, 1986, page 216. A copy of the Land Use District Map signed by Charles Pattison, page 11 of 21. A copy of the Land Use District Map signed by Donald Craig, page 231. A copy of the Existing Conditions Map of the scale 1" 2,000', page 3 of 7, dated July 2, 1985. II RECOMMENDED FINDINGS OF FACT The current land use district of 1988, indicate lots 3 and 45, block 3, Lida Subdivision to be zoned URM. The Pattison Map land use district boundary between the SC and URM land use district boundary appears to follow the south property line of lots 3 and 45 of Lida Subdivision. The applicant is requesting that land use district be pre- cisely located and that lots 3 and 45 are included in the SC district. The previous zoning (before September 15, 1986) of the en- tire property was BU-1-L. A permit was previously issued on lots 1, 2, 3, and 45, block 3, Lida Subdivision in 1980, for a medical building. BMANKOWI.01/TXTDR,August 23, 1993 A review of the records found that the Board of County Com- mission did not specifically consider this site during the preparation of the Land Use District Maps. Section 9.5-3(m), specifies the criteria that may be used in making boundary interpretations. The criteria specifies that "boundaries shown as following or approximately follow- ing any platted lot line or other prooertv line shall be construed as following such line". (Emphasis added) IV RECOMMENDED DETERMINATION The Land Use District Maps sign by Charles Pattison is impre- cise. Therefore a Boundary Determination is required and it is recommended that approval be given to precisely locating the SC/URM boundary along the south property lines of lots 3 and 45 of Lida Subdivision.
