ORDINANCE NO. 030 -2004
AN ORDINANCE BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING THE CHANGES TO THE LAND USE
DISTRICT MAP FOR BIG PINE KEY AND NO NAME KEY AS
DETAILED IN THE LIVABLE COMMUNIKEYS MASTER PLAN FOR
BIG PINE KEY AND NO NAME KEY DATED AUGUST 2004;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES
INCONSISTENT HEREWITH; AND DIRECTING THE DIRECTOR OF
PLANNING AND ENVIRONMENTAL RESOURCES TO FORWARD A
CERTIFIED COPY OF THIS ORDINANCE TO THE FLORIDA
DEPARTMENT OF COMMUNITY AFFAIRS AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, at a regularly scheduled meeting on December 17th, the Monroe County
Board of County Commissioners adopted the Livable CommuniKeys Master Plan for Big Pine
Key and No Name Key (referred to hereafter as the Master Plan) as the policy document to direct
growth and development on Big Pine Key and No Name Key; and
WHEREAS, all of the proposed Comprehensive Plan and Future Land Use and Land
Use District Map changes have been recommended by the Master Plan, as adopted on December
I ih, 2003 and the adoption resolution states that the Future Land Use and Land Use District map
changes would be brought before the commission at a subsequent hearing; and
WHEREAS, the Master Plan is the product of the Livable CommuniKeys program as
outlined in the Monroe County Year 2010 Comprehensive Plan Objective 101.20 which is to
address community needs while balancing the needs of all of Monroe County; and
WHEREAS, the Master Plan was created in conjunction with the Habitat Conservation
Plan (HCP), a mechanism required by the US Fish and Wildlife Service (USFWS) whereby the
concerns and responsibilities of the various public agencies with regard to the conservation of the
Key Deer and other covered species, and public and private development of Big Pine and No
Name Keys can be coordinated; and
WHEREAS, as a part of the comprehensive LCP process, Future Land Use and Land
Use District Map amendments are proposed to bring properties in conformity with the Master
Plan and other guiding documents; and
WHEREAS, the proposed amendments were reviewed during a meeting of the
Development Review Committee on January 5, 2004 which was continued from December 29t\
2003; and
WHEREAS, during a regularly scheduled meeting on January 14, 2004, the Monroe
County Planning Commission reviewed the amendments and recommended approval, to the
Board of County Commissioners; and

WHEREAS, the Livable CommuniKeys Master Plan for Big Pine Key and No Name
Key in Action Item 2.1.3 included the following changes to the Land Use District Map:
1. Change the acreage identified as real estate parcel numbers:
00110460.000000; 00110540.000000; 00110640.000000;
00110720.000000; 00110721.000100; 00110730.000000;
00110740.000000; 00110750.000000; 00111020.000000;
00111020.000010; 00111020.000020; 00111020.000030; and
00111020.000040 on Big Pine Key from Destination Resort (DR) to Suburban
Residential (SR) on the land use district map.
2. Change the designation of Lots 21 and 22, Tropic Island Ranchettes from Native Area
(NA) to Suburban Commercial (SC) on the land use district map.
3. Change the designation of acreage identified as real estate parcel numbers
00111470.000000 and 00111470.000100 from Suburban Residential (SR) to Suburban
Commercial (SC) on the land use district map.
WHEREAS, the Monroe County Board of County Commissioners examined the
proposed amendments to the Year 2010 Comprehensive Plan, Future Land Use and Land Use
District Maps submitted by the Monroe County Planning Department at a public hearing on
January 21 st, 2004 and approved a Transmittal Resolution to transmit the plan and Future Land
Use Map amendments to the Florida Department of Community Affairs (DCA); and
WHEREAS,; the Florida Department of Community Affairs (DCA) responded to the
County transmittal on June 29, 2004 in an Objection, Recommendations and Comments report
prepared pursuant to Rule 9J-ll.010; and
WHEREAS, the Monroe County Board of County Commissioners reviewed the report
from DCA, and amendments recommended by staff to the proposed 2010 Comprehensive Plan
and the Big Pine Key and No Name Key Master Plan and the Future Land Use and Land Use
District Map ; and
WHEREAS, The Monroe County Board of County Commissioners were presented with
the following information, which by reference is hereby incorporated as part of the record of said
hearing:
1. Staff Report prepared on July 20, 2004 by K. Marlene Conaway, Director, Planning
and Environmental Resources; and
2. The Livable CommuniKeys Program Master Plan for Big Pine Key and No Name
Key; and
WHEREAS, the Monroe County Board of County Commissioners held the second of
two public hearings on August 18, 2004 on the proposed amendments; and

WHEREAS, the Monroe County Board of County Commissioners makes the following
Findings of Fact based on the evidence presented:
1. Objective 101.20 mandates the county to complete a series of master plan documents
to address local needs while balancing the needs of all of Monroe County. The Big
Pine Key and No Name Key Master Plan is the first of the Livable CommuniKeys
plans to be completed, and require implementation of the recommended Strategies
and Action Items. The LCP Plan itself must be adopted as an amendment to and a
part of the Year 20 I 0 Comprehensive Plan. Policy 101.20.2 will provide a
mechanism to recognize individual Master Plans as they are adopted by the BOCC as
a part of the Comprehensive Plan, enabling the framework created within the plans to
have the same standing as the Comprehensive plan; and
2. Objective 105.2.2 directs the County prepare over-lay maps designating geographic
areas of the County as one of three Tiers and incorporate the maps as an overlay to
the zoning maps with supporting text amendments. The maps will be submitted to the
Board of County Commissioners and DCA for approval upon final approval of this
Plan amendment; and
3. Because the LCP master plan and the Habitat Conservation Plan create a three-tier
system to direct growth to infill areas and away from areas that contain important
native vegetation and Action Item 2.1.2 directs the County to adopt the Tier System
Map as an overlay of the Land Use District Maps; and
4. Policy 103.1.2 directs the county to replace the ACCC (Area of Critical County
Concern) designation with zoning designations consistent with the categories shown
on the Future Land Use Map (FLUM). Each of these changes are outlined in Action
Item 2.1.3 which also specifically states that Policy 103.1.2 should be deleted. These
changes will be reflected in a new zoning map to be adopted by the BOCC; and
5. Policy 103.1.8 requires that upon the adoption of the Comprehensive Plan, the
Habitat Evaluation Index (HE!) in the Land Development Regulations shall be
revised to incorporate greater consideration for the habitat of species of special status,
including the Key deer. The required changes have been completed and were adopted
as a part of the LDR's in 1999 and will not be affected by the LCP master plan; and
6. Both the HCP and the LCP encourage infill commercial development within the U.S.
I corridor area on properties already scarified. The Land Use District Map Change
from Native Area (NA) to Suburban Commercial (SC) of the properties described as
Lots 21 and 22, Tropic Island Ranchettes is consistent with the Master Plan because
the properties are scarified, have been used commercially since 1986, and are within
the U.S. 1 corridor area, where development and redevelopment are directed and
encouraged.

7. The HCP and the LCP require and provide mechanisms for the protection of the
habitat of endangered species. Part of this protection is the designation of areas in
Tier I which are to remain undeveloped or developed at the current level of
development. The properties currently designated on the Future Land Use Map as
Mixed Use Commercial (MC) and the Land Use District Map as Destination Resort
are only partially developed with residential uses, contain a large amount of native
habitat, are located within Tier I, and are not within the main U.S. I corridor where
further commercial development may occur. The change of designation to
Residential Low on the FLUM and Suburban Residential (SR) on the Land Use
District Map are more appropriate.
WHEREAS, the Monroe County Board of County Commissioners makes the following
Conclusions of Law based on the evidence presented:
1. The Livable CommuniKeys Program requires Monroe County to produce a series of
Master Plans which addresses local needs while balancing the needs of all of Monroe
County; and
2. The LCP Master Plan for Big Pine Key and No Name Key was created in conjunction
with the Habitat Conservation Plan (HCP) and implements the HCP, both of which
control development and conservation on the islands; and
3. The Master Plan is adopted as an amendment to the 2010 Comprehensive Plan and is
the policy document to direct growth and development on Big Pine Key and No
Name Key; and
4. The Master Plan, as adopted, recommends the amendments to the Land Use District
Maps; and
5. The proposed amendments are internally consistent with and further the Goals,
Objectives, and Policies of the Year 2010 Comprehensive Plan and the Principals of
Guiding Development set forth in Chapter 380, Florida Statutes; and
WHEREAS, the Monroe County Board of County Commissioners hereby supports the
recommendation of the Monroe County Planning Commission and the staff of the Monroe
County Planning Department; and
WHEREAS, it is the desire of the Monroe County Board of County Commissioners that
the following amendments to the Monroe County Land Use District Map be approved, adopted
and transmitted to the state land planning agency for approval;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support it's decision to Approve the following Land Use District
Map amendments:

Section 1. Change the Land Use District Map Designation of the properties from
Destination Resort (DR) to Suburban Residential (SR) with the following real estate numbers:

00110730.000000, 00110740.000000, 00110750.000000, 00111020.000000, 00111020.000010,
00111020.000020, 00111020.000030, 00111020.000040 and illustrated on the attached map
which is hereby incorporated by reference and attached as Exhibit 1.
Section 2. Change the Land Use District Map Designation of the properties from
Native Area (NA) to Suburban Commercial (SC) with the following real estate numbers:
00111420.000100 and 00111420.000500 and illustrated on the attached map which is hereby
incorporated by reference and attached as Exhibit 2.
Section 3. Change the Land Use District Map Designation of the properties from
Suburban Residential (SR) to Suburban Commercial (SC) with the following real estate
numbers: 00111470.000000 and 001114270.000100 and illustrated on the attached map which is
hereby incorporated by reference and attached as Exhibit 3.
Section 4. If any section, subsection, sentence, clause, item, change, or provision of
this ordinance is held invalid, the remainder of this ordinance shall not be affected by such
validity.
Section 5. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section 6. This ordinance shall be transmitted by the Planning Department to the
Department of Community Affairs pursuant to Chapter 163 and 380, Florida Statutes.
Section 7. This ordinance shall be filed in the Office of the Secretary of State of
Florida, but shall not become effective until a notice is issued by the Department of Community
Affairs or Administrative Commission finding the amendment in compliance with Chapter 380,
Florida Statutes.
