Resolution 041-1969 RESOLUTION NO. 41 -196 RESOLUTION APPROVING PLAT FOR!iIRECORD WHEREAS, The Branigar Organization, Inc., an Illinois corporation authorized to do business in the State of Florida, has requested that the Board of County Commissioners of Monroe County, Florida approve for re- cord a plat known as "PORT ANTIGUA PLAT NO.2, a Portion of Tract 5, Matecumbe Sandy Beach, p. B. 3, p. 27, Lower Matecumbe Key, Monroe County, Florida", and WHEREAS, in lieu of the bond required by the provisions of Chapter 59-1577 and Chapter 59-1578, Laws of Florida, Acts of the Legislature Year 1959, the platter of said subdivision will enter into an Agreement with the County of Monroe, State of Florida, to convey to said County Lots 17, 21 and 22, PORT ANTIGUA PLAT NO.1, as recorded in P. B. 6, p. 13, of the Public Records of Monroe County, Florida, as security for the construc- tion and paving of streets in said subdivision, and WHEREAS, the County Tax Assessor and County Zoning Director have recommended that said Board approve said plat for record, provided said Board waives the provisions contained in the above referred to laws, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the provisions of Chapter 59-1577 and Chapter 59 -15 78, Laws of Florida, Acts of the Legislature Year 1959, be, and the same are hereby waived, in that property is being accepted and pledged in lieu of a bond, so far as the plat known as "PORT ANTIGUA PLAT NO.2, a Portion of Tract 5, Matecum.be Sandy Beach, p, B. 3, p. 27, Low- er Matecumbe Key, Monroe County, Florida" is concerned, and that said plat be, and the same is hereby approved for record, and the Chairman and the Clerk of said Board are hereby authorized to sign the certificate of ap- proval on said plat, upon delivery to said Board of the~executed Agreement 'I above referred to, and delivery ot executed Deed cony ying the above re- ferred to property to said County. Re: 08-69-012.0 Port Antigua Plat No 2 Dear Mr. Cormack: Enclosed for your review are four prints of the proposed plat of Port Antigua Plat No 2. We would appreciate this plat being presented to the Board of County Commissioners at the meeting scheduled for May 13, 1969. This plat conforms to the plat filing law and was prepared in accordance with the master tentative plat of Port Antigua, a copy of which is enclosed. The developer, The Branigar Organization, Inc., will hand carry the the Warranty Deed to Key West on Thursday, May 8, 1969, so that the deed will be of record when the plat is reviewed by the Tax Assessor. The Branigar Organization, Inc., will deliver to Mr. Fred Tittle an agreement and a deed to some lots in Port Antigua Plat No 1 to cover the cost of constructing the roads and drainage facilities in the subdivision. We have estimated the cost of paving the roads and of constructing the drainage facilities at $20,000.
