A RESOLUTION URGING THAT THE LEGISLATURE AMEND SECTION
212.055(2)(i), FLORIDA STATUTESf IN ORDER TO PERMIT
COUNTIES WITH A POPULATION OF 100,000 OR LESS TO USE
THE LOCAL GOVERNMENT TAX INFRASTRUCTURE REVENUE FOR ANY
PURPOSE.
WHEREAS, Florida Statutes Chap. 212.055(2)(i) authorize
counties of less than 50,000 to use the proceeds and interest of
an infrastructure sales tax for any public purpose; and
WHEREAS, medium size counties
(50,000 to 100,000
in
population) are currently limited to using the said discretionary
sales surtax for the purpose of constructing infrastructure or
fixed capital improvements and such tax is not available for
funding the day to day costs of maintaining the improvements and
operating the said improvements, and
WHEREAS, medium size counties are particularly pressed in
the cost of maintaining and operating infrastructure projects and
are essentially as hard pressed as the small counties of the
State with respect to the necessity of funds for such purposes,
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
1. The Legislature of the State of Florida is hereby
requested to amend Section 212.055(2)(i), Florida Statutes, in
order to permit counties with an existing infrastructure sales
tax, and with a population of 50,000 to 100,000, to use that
sales tax revenue for any public purpose if authorized by an
ordinance of the County Commission.
2. The Clerk is hereby directed to send certified copies
of this Resolution to State Senator Jones, State Representative
Saunders and all other members of Legislature of the State of
Florida.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
