Resolution 095-1979 ,/. RESOLUTION #95-1979 WHEREAS, the BOARD OF COUNTY COMMISSIONERS of MONROE COUNTY, FLORIDA, did approve an application for C.J. Schlapkohl on February 7, 1979, to repair 160 feet of rip-rap seawall and to construct a wood/PVC Dock on the SW\ of Section 25, Township 66, Range 29, on Big Pine Key, and WHEREAS, Section 253.124, Florida Statutes, requires that a biological assessment be read into the records, now therefore BE IT RESOLVED that the following Biological Assessment be read and made a part of the Minutes of the County Commissioners Meeting. The applicant proposes repa~r~ng 160 linear feet of riprap revetment recovering the lost riprap from the adjacent access channel. Fifty(50)cubic yards of fill would be placed waterward of MHW behind rip-rap repair to restore uplands. Fill and riprap will be placed by clamshell. Also, proposed is a private dock waterward of a red mangrove fringe. (Rhizophora ~an~le) There would be a 5 ft. wide by 24 ft. long access pier throug t e mangroves to a 77 ft, long by 5 ft. wide "T" dock. The pier would be wood deck on concrete filled PVC pipe piles set in augered holes. There are single-family residences on deep lots along the water- front to Spanish Harbor Channel. Between these lots and U.S. #1 is a tract of undeveloped land. The applicant's property is bordered by a canal on the south and a channel on the east. The channel on the east is protected by a rock breakwater. There are two(2) separate locations of work in the proposed project. The pier will be located in a small indentation of the shoreline on an upland canal. A dense red mangrove fringe lines the shoreline of the indentation and the canal has a vertical concrete seawall west of the pier site. As proposed, the pier will not extend beyond a projected straight line of the seawall. Bottom substrate in the proposed pier location is an accumulation of silt and organic litter. The proposed rip-rap repair site is an eroding sand, marl, and rock rubble embankment. There were scattered scrub buttonwood (Conocarpuserecta) along the bank; the intertidal and subtidal zone unvegetated. Subtidally, there was an accumulation of organic detritus. There ~vill be no long-term nor short-term biological impact from this project, therefore Under the provisions of Section 253.124, Florida Statutes, this report shall be read into the record and duly considered at the same meeting at which the Board of County Commissioners or other authorized body takes final action on the application for local approval. Proof of local approval must be furnished this office before processing can be concluded. BE IT FURTHER RESOLVED, that the County Commission of the County of MONROE, Florida, does hereby approve and accept the biological assessment on the above mentioned project.
