RESOLUTION # 138-79
WHEREAS, the BOARD OF COUNTY COMMISSIONERS of MONROE County,
Florida, approved an application for John Seney on March 13, 1979,
for a Seawall and Fill, and
WHEREAS, the Department of Environmental Regulation pursuant to
Section 253.124 Florida Statutes, requires that before a State Permit
can be issued that a Biological Assessment made by DER be read into
the Minutes of the County Commission.
NOW, THEREFORE BE IT RESOLVED, that the following Biological
Assessment be read into the Minutes of the County Commission and
approved by that same body.
To construct 100' of concrete seawall along his waterward
property line, which has been eroded by wave action of boats and wind.
About 75 cubic yards of backfill will be placed behind the seawall.
Hand tools and a backhoe will be used in the construction of the wall
which will be placed at the landward edge of an artificially deepened
peripheral canal which runs along the shoreline in this area. The
upper edge of the seawall will be 4' above MHW and a 4' wide sidewalk
will cap the wall.
As much of the length of the applicant's waterward property line
has been eroded back up to 4-5', most of the work to be performed and
fill to be placed will be below MHW.
The project site is located in an old artificial uplands sub-
division created by the excavation of finger and peripheral canals.'
The site is on the open water of Lower Sugar10af Sound and a peripheral
boat channel. There is little vegetation along the shoreline of the
area and uplands vegetation is restricted to grasses and Australian
pines, (Casyruba equisetifo1ia).
The seawall is to be placed along an eroded shoreline of old
1imerock fill from the peripheral channel and some recent upland fill.
There is essentially no shoreline vegetation in the site area and the
bottom drops rapidly to the channel depth of about 10'. Across the
channel (approximately 70' wide) is the shallow (1-2') baybottom of
Lower Sugar10af Sound consisting of seagrasses, benthic algae, sponges
and marl-type sediments over caprock.
There will be no adverse impact on local biological resources
from treconstruction of this seawall and the purpose of preventing
further erosion from upland property will be served.
BE IT FURTHER RESOLVED, by the Board of County Commissioners of
MONROE County, Florida, that said Board hereby gives its approval for
the construction of the above mentioned work.
