RESOLUTION REVERSING MO~ROE COUNTY ZONING
BOARD OF ADJUSTMENT UPON APPEAL OF ARTHUR
AND BETTY DEMOTT.
WHEREAS I the Monroe County Zoning Board of Adjustment, on
July 31, 1979, denied the request of ARTHUR and BETTY DEMOTT for
a dimensional variance of 9 feet to build up to 11 feet of a canal
on the following described property:
Lot 11, Block 7 of Port pine Heights 1st Addition,
as recorded in Plat Book 4, page 120, and located
in Section 5, Township 66 South, Range 29 East,
Big Pine Key, zoned RU-l.
and,
WHEREAS, the said ARTHUR and BETTY DEMOTT having duly
appealed said decision to the Board of County Commissioners, sitting
as Board of Appeals, andfue Board having reviewed the transcript of
the July 31, 1979 hearing, having considered the argument of all
parties present wishing to speak on the matter, and all premises
considered,
BE IT RESO LVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as BOARD OF APPEALS, as follows:
1. That the decision of the Monroe County Zoning Board of
Adjustment of July 31, 1979 regarding the requested variance for
Arthur and Betty DeMott be and the same is hereby reversed.
2. That the said ARTHUR and BETTY DEMOTT be and they are
hereby granted a dimensional variance to build up to 11 feet of a
canal on the following described property:
Lot 11, Block 7 of Port Pine Heights 1st Addition.
RESOLVED in Regular Session at Marathon, Florida ~is 18th
day of Septe~ber, A.D. 1979.
