RESOLUTION NO. 303 -1978
RESOLUTION DECLARING MORATORIUM ON GRANTING
VARIANCES IN AICUZ ZONE SURROUNDING BOCA CHICA
AIR BASE IN MONROE COUNTY, FLORIDA.
In March of 1975 the County Commission of Monroe County
passed the AICUZ Ordinance which prohibited certain development
within designated zones of high noise intensity and accident
potential, and
WHEREAS, in March of 1978 certain changes were made to the
original ordinance including a provision for granting variances
to individual applicants owning private property within the areas
covered, and
WHEREAS, in the best interest of the health, safety and
welfare of the citizens of Monroe County it is reasonable to de-
clare a moratorium on granting of variances within the AICUZ zone
as established by Ordinance of Monroe County, and
WHEREAS, the Board of County Commissioners has carefully
v cnnsidered the existing facts and circumstances, and
WHEREAS, the Navy has offered to meet with County offi-
cials to assist in reviewing the existing ordinance establishing
the AICUZ zone and recommend certain changes, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. That said Board does hereby declare a ninety-day
(90) moratorium on accepting and granting of variance applica-
tions within the AICUZ zone existing at Boca Chica and adjacent
areas.
2. That said Board does direct that the Zoning Depart-
ment and other appropriate County personnel meet with the appropri-
ate Navy officials to review the existing ordinance establishing
the AICUZ zone and regulations to be followed thereunder. That
within 90 days, specific recommendations are to be presented to
the Commission by the Navy and/or County Staff setting forth pro-
posed changes and reasons for same in order to provide for the
overall interests of all concerned.

3. That the Clerk shall forward a certified copy of
this resolution to the Commanding Officer of the Boca Chica Air
Base for his information and appropriate action.
