Resolution 311-1978 RESOLUTION NO. 311-1978 A RESOLUTION AUTHORIZING THE EXECUTION OF A "CONTRACT FOR SALE AND PURCHASE" OF REAL ES- TATE. WHEREAS, the Board of County Commissioners of Monroe County, Florida, filed an application to obtain Federal funds under the Community Development Block Grant Program for the acquisition of real property for the purpose of low- and moderate-income housing under the Section 8 Housing Assistance Payments Program, and WHEREAS, the Department of Housing and Urban Development on July 7, 1976, approved said application for Non-Metropolitan Discretionary Funds in the amount of Three Hundred Thousand Dollars ($300,000), for Grant No. B-76-DN-0003, and WHEREAS, THE Department of Housing and Urban Development on July 15, 1977, approved said application for Non-Metropolitan Discretionary Funds in the amount of One Hundred Sixty Thousand Dollars ($160,000) for Grant No. B-77-DN-12-0108, and WHEREAS, all of the conditions imposed in the conditional funding approval of July 7, 1976, and July 15, 1977, have been com- plied with, and WHEREAS, the Department of Housing and Urban Development has acknowledged compliance with all of the aforementioned con- ditions required for the completion of the certificat~on process and has provided Monroe County with this final notification, and WHEREAS, Monroe County has met all compliances necessary for the release of the authorized grant in the amount of Three Hundred Thousand Dollars ($300,000) under their "Letter of Credit #86-00-4575" increased by HUD on July 23, 1976, and WHEREAS, Monroe County has met all compliances necessary for the release of the authorized grant in the amount of One Hundred Sixty Thousand Dollars ($160,000) under their "Letter of Credit #86-00-4575" increased by HUD on September 8, 1977, and WHEREAS, Monroe County has complied with the Department of Housing and Urban Development's appraisal requirements for the Page 1 of 4 Pages Af'iW -:' ,_. 'i'..i;.-U \,,1, ,___,..,~__,_'-__...;;.<,.. 0.:1.........' ~~..:_.~__.(~>(; .Il'mlIH:__ ,<::;: ~,~..~~EP,GE l' ') ~ . .t.~ ..,.., '~;-":1I:""':'_""""'.e;~_..__. purchase of real property under the Community Development Block Grant, and HHEREAS, the Board of County Commissioners has examined and hereby acknowledges that the Review Appraisal Report establishes just compensation for the real property, and ~rnEREAS, the Monroe County Housing Authority was authorized on November 22, 1977, to proceed with the negotiations for the purchase of real property for low-income housing and has secured executed Contracts for Sale and Purchase, and WHEREAS, the Contracts for Sale and Purchase, dated November 29, 1978, was executed by the owners for a price consis- tent with the appraisal for just compensation all of which was certified by the Monroe County Housing Authority in their Resolu- tion #23 adopted by their Board on Tuesday, December 5, 1978, to be in compliance with all of the applicable Federal, State and County laws and the requirements of the U. S. Department of Housing and Urban Development together with all assurances extended to the U. S. Department of Housing and Urban Development by Monroe County under Resolution #231-1976, dated December 29, 1976, in considera- tion of approval of the aforementioned grant, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, has recognized the need for 10w- and moderate-income housing in their Housing Assistance Plan and their Community Development Plan, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That the estimated market value of the real property as of November 7, 1978, in the amount of $286,500.00 is hereby approved to be just compensation (fair market value) for acquiring marketable title to the real property owned by the following: p'age 2 of 4 Pages Parcel #1: Abraham Barkett .38 acres $ 11,500 Parcel #2: Tom Barkett .76 acres 22,476 Parcel #3: George Barkett .77 acres 22,758 Parcel 41=4 : Kelly Barkett .46 acres 24.010 Parcel 41=5 : Thomas Barkett et al. 9.50 acres 215,756 11.87 acres $ 286,500 2. That the Board of County Commissioners of Monroe County, Florida, hereby ratifies and approves on behalf of the County of Monroe, State of Florida, the Contracts for Sale and Purchase between Mr. Abraham Barkett, Mr. Tom Barkett, Mr. George Barkett, Mr. Kelly Barkett and Mr. Thomas Barkett et al., and the County of Monroe, State of Florida, and authorize and direct the Chairman of the Board and other appropriate officials to execute all documents necessary to complete the purchase and sale in accord- ance with the Contracts for Sale and Purchase, all other closing documents required for the purchase of the real property, and is further authorized to transfer to the Monroe County Housing Author- ity said purchased property as set forth in Schedule "A" of the contracts and more particularly described as follows: A portion of Lot 10, in Section 28, Township 61 South, Range 39 East, P. F. JENKINS PLAT, as re- corded in Plat Book 1, at Page 68 of the Public Records of Monroe County, Florida, more particu- larly described as follows: For a point of begin- ning, commence at the Southeast corner of said Lot 10; thence run West along the South line of said Lot 10, a distance of 316.32 feet to the Easterly right-of-way line of State Road S-905; thence North 380-48'-0" East along the Easterly right-of-way line of S-905 a distance of 516.60 feet; thence run South 10-03' -0" vJest along the East line of said Lot 10, a distance of 402.67 feet to the point of beginning, containing 2.37 acres, more or less; and All that part of Lot 9 of Section 28, Township 61 South, Range 39 East, lying Southeasterly of a line which is parallel to, and 70 feet distant Southeasterly of and measured at right angles to the center line of the Florida East Coast Railway as now located and constructed over and across said Lot 9, according to survey made by P. F. JENKINS, C.E., and plat there of recorded in Plat Book 1, Page 68 of the Public Records of Monroe County, Florida, containing 8.5 acres, more or less, for a total of 11.87 acres, more or less. SUBJECT TO the following conditions and/or under- standing: The deposit for all contracts shall be held by Monroe County until closing and shall not be held by David Paul Horan Trust Account. ~age 3 of 4 Pages 3. Further, that in order to assure that the program achieves the utmost, that upon each person applying to rent or purchase any of the housing facilities to be constructed on the above property that appropriate officials of the County and/or State examine the facilities which said applicant is vacating or has vacated in Monroe County to assure that positive action is taken to mandate that the vacated facilities comply with all existing health, sanitation or building codes, regulation rules or otherwise of Monroe County and/or the State of Florida, prior to reoccupancy of the dwelling. 4. That the above program shall be developed at a rate which meets the needs of the citizens in the area. '" 5. That Monroe County Housing Authority shall ~iligently (' - pursu~ a rehabilitation program for substandard housing on all the Florida Keys, and submit a semi-annual status report in writing commencing June 1, 1979. 6. That the Monroe County Housing Authority utilize a minimum of 2.7 acres under a home ownership program or other appropriate programs for purchase. 7. That the Monroe County Housing Authority shall present to the Board of County Commissioners the plans and specifications for any housing to be constructed on the site in question for their consent and final approval.
