RESOLUTION NO. 64 -1980
RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD
OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
TO EXECUTE AN AMENDMENT TO MEMORANDill1 OF AGREEMENT
TO PROVIDE PROFESSIONAL SERVICES BY AND BETIVEEN
MONROE COUNTY, FLORIDA, AND MICHAEL H, CATES.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, as follows:
That the Chairman of the Board is hereby authorized to
execute an Amendment to Memorandum of Agreement to Provide
Professional Services by and between Monroe County, Florida,
and Michael H, Cates, a copy of same being attached hereto.
Passed and adopted by the Board of County Commissioners
of Monroe County, Florida, at a regular meeting held on the
11th day of March, 1980.

AMENDHENT TO MEMO RAN DUN OF AGREEMENT
TO PROVIDE PROFESSIONAL SERVICES
THIS AGREEMENT entered into this

1980, by and between MONROE COUNTY, FLORIDA, a political subdivision
of the State of Florida, hereinafter referred to as "County" and
MICHAEL H. CATES, Attorney, hereinafter referred to as "Attorney",
WITNESSETH:
WHEREAS, the parties did enter into a Memorandum of Agreement
dated the 1st day of November, 1977, and
WHEREAS, the Assistant County Attorney has resigned along with
his secretary, and
WHEREAS, pursuant to the original agreement of the parties,
the mutual consent for the employment of all employees in the Legal
Department is required, now, therefore,
IN CONSIDERATION of the mutual covenants, promises, and
premises herein contained, the parties agree:
1. That the Agreement dated November 1, 1977, is hereby
amended to include clauses 4 (d), (e), (f), (g), and (h):
4. (d)
The parties hereby mutually agree that the
following shall be engaged as Assistant
County Attorneys under this agreement in
accordance herewith:
(1) Randall W, Winter, fee - $11;500.08 per year,
(2) Kirk C, Zuelch, fee - $11,500,08 per year.
(e) The Assistant County Attorneys shall receive,
in addition to the aforesaid sums, all bene-
fits and services received by other County
employees, including but not limited to
medical, retirement, social security benefits,
salary increases, etc., except Career Service
status and shall be allowed to continue
their private practice.

(f) The County agrees to provide the Attorney the
sum of $9,600.00 to compensate said Attorney
for the employment of secretarial services
for the Assistant County Attorneys' use. Said
sum to be paid in equal monthly installments
with the first payment to be made April 1,
1980.
(g) The County agrees to provide an additional
supplement in the amount of $500.00 per month
with the first payment to be made April 1,
1980, to compensate said Attorney on a flat fee
basis for the use of his office, copying equip-
ment and custodial services as required by the
Assistant County Attorneys,
(h) The County agrees to reimburse the Assistant
County Attorneys for travel, meals and other
expenses incurred while on County business.
2. All terms and conditions contained in that agreement
dated November 1, 1977, and the Amendment to Memorandum of Agree-
ment to Provide Professional Services dated August 14, 1979, shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement the day and year first above written.
