RESOLUTION NO. 83-1980
RESOLUTION UPHOLDING DECISION OF MONROE COUNTY
ZONING BOARD OF ADJUSTMENT GRANTING CHANGE OF
ZONING REQUESTED BY PAULINE DUGGAN.
WHEREAS, the Monroe County Zoning Board of Adjustment, on
September 28, 1979, approved the request of Pauline Duggan for
a zoning change from BU-l and BU-2 to BU-2E with an existing
BU-l and BU-2 on the following described property:
Beginning at a point where the West boundary line of
Lot 18, Section 32, Twp. 61 S, Rge. 39 E, intersects
with the South boundary line of the Old or North
Dixie Hwy., and running thence in a northeasterly
direction along said South boundary line of said Old
or North Dixie Hwy. a distance or 394' to the POINT
OF BEGINNING; thence run Southeast to the North
boundary line of the New Dixie Highway, thence run in
a Northeasterly direction along the North line of the
New Dixie Hwy. a distance of 75'. Thence run North-
west to the South boundary line of the Old or North
Dixie Hwy. Thence run in a Southwesterly direction
along the South line of the Old or North Dixie Hwy.
a distance of 75' to the POINT OF BEGINNING, lying
in Monroe County, Florida. AND a portion of Lot 6,
according to Plat of ROCK HARBOR M&~OR on Key Largo,
as recorded in Plat Book 2 at Page 54 of the Public
Records of Monroe County, Florida, said portion of
Lot 6 having a frontage of 57.08' on New Hwy. (State
Road No.5), and being more particularly described
as follows: Beginning at the Northwest corner of said
Lot 6 on the New Hwy., as per said Plat of ROCK HARBOR
MANOR, and run Southeasterly along Southwesterly side
of said Lot 6, to a point of intersection with a line
which runs Southeasterly from a point on the South-
easterly Right of Way line of "New Hwy." which said
point is 57.08' Northeasterly from the said Northwest
corner of Lot 6, to a point on the Northwesterly
Right of Way line of the "Old Hwy.", said point being
10' Southwesterly from the Southwest corner of said
Lot 6, thence run Northwesterly on last described
line to a point on the Southeasterly Right of Way of
"New Hwy." (Northwesterly side of said Lot 6) which
point is 57.08' Northeasterly from the said Northwest
corner of said Lot 6; thence run Southwesterly along
said Southeasterly Right of Way line of "New Hwy.",
a distance of 57.08' to the said Northwest corner of
Lot 6, and the POINT OF BEGINNING.
and,
WHEREAS, Mr. and Mrs. George Weilander filed an appeal with
the Board of County Commissioners of Monroe County, Florida,
acting as the Board of Appeals asking the Board to reverse the
decision of the Monroe County Zoning Board of Adjustment in
accordance with the laws applicable thereto, and

WHEREAS, on March 25, 1980, the Board of County Commis-
sioners of Monroe County, Florida, acting as the Board of Appeals
held such appeal, and after reviewing the transcript of the
September 28, 1979, hearing, having considered the argument of all
parties present wishing to speak on the matter, and all premises
considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as follows:
1. That the decision of the Monroe County Zoning Board of
Adjustment of September 28, 1979, regarding the requested zoning
change for Pauline Duggan be and the same is hereby upheld.
2. That the said Pauline Duggan be and she is hereby granted
a zoning change from BU-l and BU-2 to BU-2E with an existing
BU-l and BU-2 on the above described property.
RESOLVED in regular session of the Board of County Commis-
sioners of Monroe County, Florida, at Key West, Florida, this
25th day of March, A.D. 1980.
