RESOLUTION 4fr_,90-1980
WHEREAS, the BOARD OF COUNTY COMMISSIONERS of MONROE County,
Florida, has received an application from Dorothy and Roland Howell,
proposing to:
Protect shoreline of a lot located a junction of canal and Garden
Cove waterway channel by placing boulder riprap at "algae line" (ML"J
line) and back-filling with 133 cubic yards of material waterward of MHW
line and 667 cubic yards of fill landward of MEW line. The proposed
riprap is 220 feet in linear distance following the natural curve of
the MLW line along Garden Cover, continuing around the corner a short
distance along the canal bank.
The applicant also proposes to construct an 86 linear foot concrete dock
and bulkhead along canal bank adjacent to a proposed twelve foot wide
boat ramp. The dock is proposed to be six feet wide and to be used to
moor a private boat.
Equipment and material will be brought to the site over owner's upland
and existing roads. Riprap is to be placed manually with aid of backhoe
to insure boulders are set landward of vegetation line to prevent dis-
rupting marine ecosystem.
This upland area, designated as Garden Cove, is immaiately adjacent to
a body of water also designated as Garden Cove and is approximately
20% developed for residences. The remainder of the area is unoccupied.
Vegetation is terrestrial pioneer and/or weed species on the undeveloped
areas. Vegetation on homesites is ornamental; natural and/or trans-
planted. Terrestrial vegetation on the upland adjacent mproject is
grass, a palm and a few small buttonwoods.
Applicant proposes to align riprap landward of "algae line", an area
composed of small pieces of coral rock and devoid of plant growth. A
similarly positioned riprap seawall presently exists (See foreground
of Photo #2) to south of proposed project. The vegetation here is green,
brown, and red algae, and more lush than on the area proposed to be
filled adjacent to the Garden Cove channel.
Although the canal bank is less effected by wave action, vegetation along
this area is green and brown algae with a few Caulerpa sp plants. Two
red mangrove propagules are growing in the area of proposed bulkhead
and dock.
As the "algae line" is the MLW line along the east side of pro ject,
"impact of this project will be minimal as no established vegetation
is to be covered, according to applicant."
"As the existing canal wall is nearly vertical, the installation of the
bulkhead will little alter the attitude of attachment sites. Cutting
of the canal bank to install a boat ramp will have minimal effect."
BE IT FURTHER RESOLVED, by the Board of County Commissioners of
Monroe County, Florida, that said Board hereby given its approval for
the constructiort of the above mentioned project.

The applicant proposes the construction of a rip-rap seawall of about
225 feet in length, which would affront Garden Cove Bay (Atlantic), and
about 85 feet of canal concrete bulkhead. This bulkhead/seawall would
uacessitate the depositing of about 130 cubic yards of marl material
~aterward of the mean hign water line.
The plans, as submitted, indicate that the rip-rap placement and back
fill would not extend beyond or into the diversified benthic algae bay
bottom community.
The proper~y in question is residential, and is comprised of previously
filled wetlands. Erosion has occurred along this altered shoreline,
accelerated by wind and boat wave actions. Beyond the eroded fill portion,
~hich is void of any macro biota, there exists the algae Caulerpa sp.,
l~limeda sp., Acetabularia sp. and Batophora sp., as well as various
Rhodophitic and Phaeeophytic types. The fish Lutianus sp. and La~odon sp.
(snappers & pinfish) were noted off shore.
The placement of this proposed rip-rap seawall, with necessary back fill.
would result in the beneficial effects of stabilizing this shore line and
preventing further erosion.
Recommendation - approval
DER & COE permits would be required; attached is a DER bio-survey.

As we advised you on November 30, 1979 , your application is
incomplete without local approval, pui~an~ to Section 253.124,
Florida Statutes, for fillina waterward of the existing mG~n/
ordinary high water line. -
Please submit the enclosed copy of our biological CO~~tcnts
together with your pel~it application to the Board of County
Commissioners/City Councilor their authorized perrnitting
authority. Section 253.124, Florida Statutes, states that the
county commission/city council ". . .shall have in hand the
(biological) report and findings thereof." It further states,
"The report shall be read into the record and duly considered
at the same meeting at which the board of county commissioners
or other authorized body takes final action on the application
for permit."
You will need to obtain a copy of the minutes of the meeting
or an appropria'te indication of the local approval. This
letter, resolution or copy of the minutes should be sent to
this office. Your application will remain incomplete without
valid local approval. If you have any questions concerning
this procedure, please contact us.

A. Description of proposed project and construction techniques.
Quantify area of project which extends into waters of the state
(including the submerged lands of those waters and the transi-
tional zone of the submerged land) as defined in Section 17-4.02
and Section 17-4.28, Florida Administrative Code.
B. Biophysical features of general area. Include comments concerning
extent of development of adjoining properties as well as relevant
historical facts about the area.

A. Applicant proposes to protect shoreline of a lot located
at junction of canal and Garden Cove watervmy channel by
placing boulder ripran at "algae line"(HLH line) and back-
filling with 133 cubic yards of material waterward of ~1mv
line and 667 cubic yards of fill landtvard of HHH line.
The proposed riprap is 220 feet in linear distance follow-
ing the natm..al curve of the ?fLH line along Garden Cove,
continuing around the corner a short distance along the
canal bank\~
\
The applicnrit also proposes to construct an 86 linear
foot concrete dock and bulkhead along canal bank adjacent
to a proposed twelve foot wide b02t ramp. The dock is pro-
posed to be six feet wide and to be used to moor a private
boat.
Equipoent and material will be brought to the site over
mmer's upland and existing roads. Riprap is to be pla:ed
manually with aid of backhoe to insure boulders are set
landward of vegetation line to prevent disrupting marine
ecosystem.
B. This upland area, designated as Garden Cove, is in~ediately
adjacent to a body of water also designated as Garden Cove
and is approximately 20% developed for residences. The
remainder of the area is dnoccupied. Vegetation is terres-
trial pioneer and/or weed species on the undeveloped areas.
Vegetation on homesites is ornamental; natural and/or trans-
planted. Terrestrial vegetation on the upland adjacent to
project is grass, a palm and a few small b~ttonwoods.
C. Applicant proposes to align riprap landward of "algae lir,e",
an area composed of small pieces of coral rock and devoid
of plant growth. A similarly positioned riprap seawall
presently exists (See foreground of Photo #2) to south of
proposed project. The vegetation here is green, brown,
and red algae, and more lush than on the area proposed to
be filled adjacent to the Garden Cove channel.
