WHEREAS, the property more specifically described by metes and bounds in exhibits 1 & 2 attached, described as pqrt Gov~nment Lot . w-- z 3, Section 23, Township 63, Range 37, Windley Key;-,: MonroEbCounty, .- ~ Florida, is currently zoned Suburban Commercial and Subu~an Resi- dential; and -. WHEREAS, the applicants request that the zoning be c~ngeci:to align the zones, which are Suburban Residential/Suburban Commer- cial with the property lines as they appear to be shown on the Pattison Maps; and WHEREAS, the Board of County Commissioner on June 12, 1985, approved the zoning designation of Suburban Commercial for the disturbed highway frontage and the remainder as Suburban Residen- tial; and WHEREAS, Senior Biologist, Bob Smith, and Planner, Donna Bosold, made a site visit and took field measurements of the dis- turbed area of the highway frontage on August 2, 1991; and WHEREAS, the field measurements taken showed that the Pattison 8 101 5 0 Wtt I 2 8 5 P!~GE I 6 4 4 Maps and the Craig Land Use District Maps are both imprecise; and WHEREAS, the Land Use District Maps contained a drafting error when adopted on September 15, 1986, and therefore the subsequent maps are also in error, because they do not follow the disturbed area of highway frontage which was the unanimous direction by the Board of County Commissioners June 12, 1985, to be Suburban Commer- cial and the remainder as Suburban Residential; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1) The action of the Planning Director, which recommends that the field measurements taken by the Senior Biologist and the Plan- ner be used to correctly place the boundary on the current Land Use District Map, as outlined in the Land Use District Map Boundary Interpretation Number 77, dated Nov. 18, 1993, which is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Monroe County Code, and therefore approved; and that 2) The above described property should be designated as Subur- ban Commercial for the disturbed highway frontage and the remainder as Suburban Residential as approved by the Board of County Commis- sioners on June 12, 1985; and that 3) The above conclusion of law, is predicated upon the finding of facts and conclusions outlined in the staff recommendation which this Board hereby adopts as its own. 4) The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning / Department. 2 .. b ~ n OFf I 2 ~ C; PAr,E I 6 4 5 5) The Clerk of 8hboB ~~ is h~~~y di~ecced to forward a certified copy of this resolution to the Florida Department of Community Affairs. 6) The Clerk of the Board is hereby directed to file a certi- fied copy of this Resolution in the Public Record of Monroe County, Florida. Listed below are the recommended findings & conclusions. II SUMMARY OF INFORMATION AND DOCUMENTARY EVIDENCE (ATTA9HED) Application by Agent, James Mattson for Windley Key Proper- ties, Inc., and Gulf Windley Corporation. A copy of the REDI Aerial Photo Map Atlas from the 25 Edi- tion, dated 1990, at a scale of 1" = 600', page 81. A copy of Monroe County Zoning Maps Pre-September 15, 1986, page 284. . A copy of the Land Use District Map signed by Charles Pattison, page 4. A copy of the Land Use District Map signed by Donald Craig, page 171. A partial copy of the survey by Hal Thomas, #3925 A copy of the Existing Conditions Map, sheet #240 I I I FEG.9MMEND~D IJNDINGS OF FACT The current use of the land is Suburban Commercial (SC) and Suburban Residential (SR) for a portion of the parcel with RE: #00093900. The parcel with the RE: #00094300-000100 is zoned SC. The previous zoning (before September 15, 1986) of the prop- erty was GUi and the zoning of the property on the Land Use District Maps of Monroe County Florida approved by the BOCC, February 28, 1986, was SR and SC. The BOCC unanimously approved that the zoning be designated as SC for the disturbed highway frontage and the remainder as SR. The subject parcel was inspected on 8-2-91 by Robert Smith, Senior Biologist and Donna Bosold, Planner which resulted in the following determination: That the disturbed area is shown by the yellow lines over the survey from Hal Thomas #3925. The disturbed area as determined by Bob Smith is shown over the Hal Thomas survey. The disturbed area as field mea- sured by the Biologist does not correspond to the zoning dis- trict of SC denoted on the Craig Land Use District Maps or the Pattison Maps. The Pattison Maps were drafted in error contrary the Board of County Commissioner direction on June 12, 1985. IV RECOMMENDED DETERMINATION The Land Use District Maps signed by Donald Craig are imprecise and should be corrected as field measured by Senior Biologist, Bob Smith, on the existing Land Use District Maps, so that the map accurately reflects the zoning for the disturbed area as permitted by the BOCC minutes of 6/12/85. However, the request by the applicants to change the zoning to correspond with the zoning on the Pattison Maps should be denied, for their request would require a map amendment to be processed.
