Resolution 236-1980 RESOLUTION NO.236- 1980 A RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA TO EXECUTE AN AGREEMENT BY AND BETWEEN THE MONROE COUNTY STATE ATTORNEY AND THE COUNTY OF MONROE, STATE OF FLORIDA, FOR PROVIDING AN ASSISTANT STATE ATTORNEY TO PROSECUTE VIOLATIONS OF THE SPECIAL LAWS AND ORDI- NANCES OF THE COUNTY. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: That the Chairman of the Board of County Commissioners of Monroe County, Florida, is hereby authorized to execute an Agreement by and between the Monroe County State Attorney and the County of Monroe, State of Florida, a copy of same being attached hereto, for providing an Assistant State Attorney to prosecute violations of the Special Laws and Ordinances of the County. Passed and adopted by the Board of County Commissioners of Monroe County, Florida, at a regular meeting held on the 23rd day of September, 1980. AGREEMENT THIS AGREEMENT, entered into this 23rd day of September , 1980, by and between the Monroe County State Attorney, hereinafter referred to as "State Attorney" and the County of Monroe, State of Florida, a political subdivision of the State of Florida, hereinafter referred to as "County", WITNESSETH: WHEREAS, the State Attorney has offered to provide the services of a Special Assistant State Attorney to pros- ecute violations of Special Laws and Ordinances of the County, and, WHEREAS, the County did provide funding ln its bud- get for 1980-81 in the amount not to exceed $3,750.00 for the purpose of providing for a Special Assistant State Attorney, now, therefore, IN CONSIDERATION of the mutual promlses, covenants and conditions herein contained, the parties hereto agree as follows: 1. That the State Attorney shall appoint a Special Assistant State Attorney whose sole function shall be to pros- ecute violations of the Special Laws and Ordinances of the County in accordance with Florida Law E.S. 27.34. 2. That the County agrees to appropriate for the salary of said Special Assistant State Attorney for the period from October 1, 1980 to December 31, 1980, the sum of Three Thousand Seven Hundred Fifty Dollars ($3,750.00). 3. That upon receipt of monthly-or bi-month1y In- VOlces, the County shall make payment directly to the Special Assistant State Attorney appointed and designated by the "State Attorney". Further, the parties agree that the total expendi- tures for salary shall not exceed the $3,750.00 appropriation.
