vffiEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
has received an application from WILLIAM H. GRAY, and
WHEREAS, in compliance with State Statute, it is necessary as part of
the permitting procedure to read the following Biological Assessment into
the Record, as follows:
The Applicant proposes the placement of 20 cubic yards of fill and
25 cubic yards of riprap along a residential shoreline and the excavation of
a 35' x 25' x 5' inland basin to be used as a swimming area. This excavated
swimming area will be connected to Cudjoe Bay by a five foot wide water
exchange opening. Length of this opening will be approximately 4 feet.
Applicant's revised drawings indicate the depth of this channel to be 20 inches
MLW.
Approximately 40 cubic yards will be excavated for the swimming area.
Half of this will be used for the building pad and the other half for the
shoreline extension. An undetermined amount of white beach sand will be
deposited around the fringe of the swimming area.

A 6' wide boardwalk will be constructed around all sides of the basin
except the eastern or landward side. This boardwalk will sit on top of the
proposed riprap and will be slightly elevated over the basin opening to form
a foot bridge. Riprap will be hand placed with the aid of a backhoe. All
equipment and materials will be brought to the site via existing roads.
The project site is located on the eastern shoreline of Cudjoe Bay on
Cudjoe ~ey. Cudjoe Bay is a shallow (five feet deep, maximum) water body
opening into the Atlantic Ocean south of Sugarloaf Channel. The shoreline
of Cudjoe Bay is rapidly being developed for single family residences.
Canals and channels have been excavated primarily on the east and west sides
of the bay and fill has been placed along much of the shoreline. The majority
of the shoreline vegetation is secondary, although regrowth is rapid.
Cutthroat Estates is bordered on its waterward side by a man-made
peripheral channel approximately 20 feet wide and 5 feet deep. Because of the
shallow depths and the high productivity of the area, seagrasses have totally
re-established themselves in this channel. These seagrasses extend landward
from the channel to the mean low water line and are mixed here with luxuriant
algae communities. Waterward of this channel are seagrass, algae, and soft
coral communities.
The applicant presently owns two lots bordering Cudjoe Bay to the west
and a deep man-made canal to the south. Canal frontage is 170 feet and bay
frontage is 125 feet. These lots are naturally low lying lots with a Miami
oolite substrate. Fill was placed here, possibly at the time of the peripheral
channel excavation, but because of its loose uncompacted characteristics it
has eroded along the shoreline. The applicant has apparently attempted to
stabilize this shoreline by pouring concrete in various places along the
apparent mean high water line.
The upland portion of these lots are relatively barren of vegetation with
the exception of several species of upland grasses. The canal side of these
lots drops sharply at its shoreline to an undetermined depth. Below the erosion
line, the intertidal zone on the bay side is a gently sloping bottom consisting
of limestone rubble.

If allowed to return to a natural state, red and black mangroves (Rhizophora
mangle and Avicennia germinans respectively) would repropagate this shoreline,
as evidenced by numerous seedlings of these species on adjacent lots. Sea
purslane (Sesuvium portulacastrum) was also observed growing just above the mean
high water line on an adjacent lot.
Benthic fauna along the applicant's intertidal area, as observed during the
on-site inspection, consisted of numerous false ceriths (Batillaria minima),
thin-shelled oysers (Isognomon sp), a sharp-ribbed drill (Eupleura sulcidentata),
nerites (Nerita sp) and an unknown species of limpet. A juvenile blue crab
(Callinectes sapidus) was also observed in this area.
Below the intertidal zone is a 5-10 foot wide shelf with a depth of 0-12 inches
at low tide. This shelf supports an extremely productive community of turtle-
grass (Thalassia testudinum), manatee grass (Syringoduim filiformis), Batophora sp,
Acetabularis sp, Penicillus sp, and Acanthophora sp. Total benthic area covered
by this vegetative growth below MLW is estimated at 90 percent.
Those species observed along the above mentioned shelf and which utilize the
area as a feeding site include snapper (Lutjanus sp), barracuda (Sphyraena barracuda)
juvenile fish and sea squirts. As referred to in 2nd paragraph of this report,
the shallow peripheral channel further offshore from the above ledge exhibits a
well-established growth of turtle grass.
The project, as proposed, will have an immediate impact upon the existing
shoreline by eliminating at least 20 square feet of productive benthic biola and
most of the intertidal zone presently fronting Cudjoe Bay. Because of the
shallow depth of the water exchange opening and the small area excavated, the
presently productive bay bottom should, in the long term, reestablish itself
rapidly, judging from nearby areas that have been excavated. The placement of
riprap should substitue for the habitat lost by the filling of the intertidal
area so that this short term impact should also be offset over a period of time.
The longer term adverse impacts anticipated from the proposed excavation of
the swimming area are of considerably more concern. A basin of this type will
facilitate increased upland runoff, further contributing to the nutrient load,
which is expected to be high because of poor water circulation within the
swimming area. Further complicating this problem will be the lack of nutrient
filtering and assimilation from either shoreline vegetation or benthic flora along
the bottom of the swimming area, assuming this area is kept free of vegetation
for swimming. An additional concern is the reduction of biological integrity
within the basin if used entirely for swimming.

PURPOSE:
This project is to be reviewed by the Board of County
Commissioners in accordance with Honroe County Ordinance
13-1980; fill below mean hiRh water.
DISCUSSION:
Applicant proposes to place 150 linear feet of rip-rap
along his shoreline property and backfill with approximately
200 cubic years of fill. Both the rip-rap and fill will be
pI aced wa t e rward 0 f ~fHW in Cud'; 0 e Bay.
At one time, the applicant proposed a swimming basin, but
due to objections by the ryepartment of Environmental Regulation,
this aspect of the project was elininated. A flora and fauna
list is presented in the attached DER report.
REASON ~OR PROJECT:
To reclaim eroded land and to prevent future erosion.
EVALUATION:
The placement of fill will eliminate the existing inter-
tidal flora and fauna in the short term, however, these species
will re-establish themselves on the rip-rap seawall.
According to the project sketch submitted by Hr. Gray,
the offshore turtlegrass (Thala~~ial will not be affected.

A. Applicant proposes the placement of 20 cubic yards of fill and
25 cubic yards of riprap along a residential shoreline and the
excavation of a 35' x 25' x 5' inland basin to be used as a
swimming area. This excavated swimming area will be connected
to Cudjoe Bay by a five foot wide water exchange opening.
Length of this opening will be approximately 4 feet. Applicant's
revised drawings indicate the depth of this channel to be 20"
MLW (drawing #5).
Approximately 40 cubic yards will be excavated for the swimming
area. Half of this will be used for the building pad, and the
other half for the shoreline extension. An undetermined amount
of white beach sand will be deposited around the fringe of the
swimming area.
Riprap to be deposited for shoreline stabilization will be
approximately 3-4 feet in diameter on the outside or waterward
side. Smaller diameter riprap (3-6 inches) will be placed
behind the larger riprap to prevent runoff of newly placed fill.
A 6' wide boardwalk will be constructed around all sides of the
basin except the eastern or landward side. This boardwalk will
sit on top of the proposed riprap and will be slightly elevated
over the basin opening to form a foot bridge.
Riprap will be hand placed with the aid of a backhoe. All equip-
ment and materials will be brought, to the site via existing roads.
B. The project site is located on the eastern shoreline of Cudjoe
Bay on Cudjoe Key. Cudjoe Bay is a shallow (five feet deep,
maximum) water body opening into the Atlantic Ocean south of
Sugarloaf Channel. The shoreline of Cudjoe Bay is rapidly
being developed for single family residences. Canals and channels
have been excavated primarily on the east and west sides of the
bay and fill has been placed along much of the shoreline. The
majority of the shoreline vegetation is secondary, although re-
growth is rapid.
Cutthroat Estates is bordered on its waterward side by a man-made
peripheral channel approximately 20 feet wide and 5 feet deep.
Because of the shallow depths and the high productivity of the
area, seagrasses have totally re-established themselves in this
channel. These seagrasses extend landward from the channel to
the mean low water line and are mixed here with luxuriant algae
communities. Waterward of this channel are seagrass, algae,
and soft coral communities.

C. The applicant presently owns two lots bordering Cudjoe Bay to
the west and a deep man-made canal to the south. Canal frontage
is 170 feet and bay frontage is 125 feet. These lots are
naturally low lying lots with a Miami oolite substrate. Fill
was placed here, possibly at the time of the peripheral channel
excavation, but because of its loose uncompacted characteristics
it has eroded along the shoreline. The applicant has apparently
attempted to stabilize this shoreline by pouring concrete in
various places along the apparent mean high water line.
The upland portion of these lots are relatively barren of vege-
tation with the exception of several species of upland grasses.
The canal side of these lots drops sharply at its shoreline to
an undetermined depth. Below the erosion line, the intertidal
zone on the bay side is a gently sloping bottom consisting of
limestone rubble. If allowed to return to a natural state, red
and black mangroves (Rhizophora mangle and Avicennia germinans
respectively) would repropagate this shoreline, as evidenced by
numerous seedlings of these species on adjacent lots. Sea
purslane (Sesuvium portulacastrum) was also observed growing just
above the mean high water line on an adjacent lot.
Benthic fauna along the applicant's intertidal area, as observed
during the on-site inspection, consisted of numerous false ceriths
(Batillaria minima), thin-shelled oysters (Iso?nomon sp), a sharp-
ribbed drill (Eupleura sulcidentata), nerites Nerita sp), and
an unknown species of limpet. A juvenile blue crab (Callinectes
sapidus) was also observed in this area.
Below the intertidal zone is a 5-10 foot wide shelf with a depth
of 0-12 inches at low tide. This shelf supports an extremely
productive community of turtle grass (Thalassia testudinum),
manatee grass (Syringoduim filiformis), Batofhora sp; Acetabularis
sp, Penicillus sp, and Acanthophora sp. Tota benthic area covered
by this vegetative growth below MLW is estimated at 90 percent.
Those species observed along the above mentioned shelf and which
utilize the area as a feeding site include snapper (Lutjanus sp),
barracuda (Sphyraena barracuda), juvenile fish and sea squirts.
As referred to in Part B of this report, the shallow peripheral
channel further offshore from the above ledge exhibits a well-
established growth of turtle grass.

D. The project, as proposed. will have an immediate impact upon the
existing shoreline by eliminating at least 20 square feet of
productive benthic biola and most of the intertidal zone presently
fronting Cudjoe Bay. Because of the shallow depth of the water
exchange opening and the small area excavated, the presently
productive bay bottom should, in the long term, reestablish
itself rapidly, judging from nearby areas that have been ex-
cavated. The placement of riprap should substitute for the habitat
lost by the filling of the intertidal area so that this short
term impact should also be offset over a period of time.
The longer term adverse impacts anticipated from the proposed
excavation of the swimming area are of considerably more concern.
A basin of this type will facilitate increased upland runoff.
further contributing to the nutrient load, which is expected to
be high because of poor water circulation within the swimming
area. Further complicating this problem will be the lack of
nutrient filtering and assimilation from either shoreline vege-
tation or benthic flora along the bottom of the swimming area,
assuming this area is kept free of vegetation for sw~ing.
An additional concern is the reduction of biological integrity
within the basin if used entirely for swimming.
