WHEREAS, Florida Statutes~ Sections 121.021 and 121.055,
which define and govern membership within the Florida "Senior
Management Service Class" within the Florida Retirement System,
was amended during the 1993 legislative session to enable "local
agency employers" to designate specified positions within their
respective agencies for inclusion within the "Senior Management
Service Class;" and
WHEREAS,
Florida
Statutes,
Section
121.055(1)(b)1.b.
provides for the designation of at least one
non-elected
full-time position as being in the Senior Management Service
Class for each local agency employer which reports to the
Division of Retirement, and provides for the designation of up to
0.5 percent of the regularly established positions within a local
agency as being in the Senior management Service class, where the
local agency has 600 or more regularly established positions; and
WHEREAS, Florida Statutes 121.055(1)(b)1.c. provides that
each position which is designed by a local agency as being within
the Senior management Service Class must be a managerial of
policy-making position, filled by an employee not subject to a
continuing contract or given Civil Service protection; and who
either heads an organizational unit or has responsibility to
effect or recommend personnel, budget, expenditure or policy
decisions in that employee's area of responsibility; and
WHEREAS, Section 121.055(1)(g), Florida Statutes, provides
that an employer may purchase past-service credit on behalf of
designated Senior Management Service Class members retroactive to
February 1, 1987; and
WHEREAS, the Board of County Commissioners has determined
that the position of County Attorney meets the requirements
established by Section 121.055, Florida statutes, for designation
of positions within a local agency as being within the Senior
Management Service Class; and
WHEREAS, the Board of County Commissioners desires to
purchase past-service credit on behalf of the directly appointed
position of County Attorney, retroactive to July 1, 1988; and
WHEREAS, the Board of County Commissioners has determined
that it is a local agency employer under the terms of Florida
Statutes, Section 121.021;
NOW, THEREFORE, BE IT RESOLVED, that the following
within Monroe County Government is hereby designated
purposes of Florida Statutes, Section 121.055, as being
the Senior Management Service Class:
County Attorney
BE IT FURTHER RESOLVED, that the Board of County
Commissioners purchase credit for past years of service within
the Senior Management Service Class. for the position of County
Attorney, retroactive to July 1, 1988, and the Clerk is directed
to deduct the employee's car allowance from his salary and credit
position

125% of such sums toward reimbursing the County for such
retroactive credit purchase, said credit being equal to the
County's cost.
THIS RESOLUTION shall become effective January 1, 1994.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
