ITEM BACKGROUND: Permits for the removal of invasive exotic vegetation currently must be issued on a parcel specific basis. Invasive exotic removal programs presently conducted by not-for- profit conservation agencies may involve entire subdivisions with multiple developed and vacant private parcels, common areas, and publicly owned parcels and rights-of-way, thus creating permitting difficulties. A blanket permit option for approved not-for-profit agencies will facilitate invasive exotic removal programs. WHEREAS, the Monroe County Year 2010 Comprehensive Plan and the Monroe County Land Development Regulations encourage removal of invasive exotic vegetation on privately and publicly held land; and WHEREAS, current Monroe County Code permitting requirements for invasive exotic removal are specific to and require individual permits for each parcel affected; and WHEREAS, not-for-profit conservation agencies work within subdivisions to conduct invasive exotic removal programs that involve multiple developed and vacant parcels under private and public ownership; and WHEREAS, obtaining individual invasive exotic removal permits for the multiple parcels involved creates difficulties for those conservation agencies and hinders the progress of invasive exotic removal; and WHEREAS, providing availability of a blanket permit for the removal of invasive exotic vegetation to not-for-profit conservation agencies as approved by the county biologist will facilitate the removal of invasive exotics from private and public lands; and WHEREAS, based on the above findings, the Board has determined that it is necessary and desirable to create the above referenced Monroe County Code; and NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. Section 6-17( c), MCC, is hereby created to read as follows: (c) Blanket Invasive Exotic Removal Permit: An annually renewable blanket permit for the removal of invasive exotic vegetation is available to not-for-profit conservation agencies as approved by the County Biologist. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Page I of2 Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. The provision of this ordinance shall take effect immediately upon receipt of the official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Section 6. The Clerk of the Court is hereby directed to forward a copy of this Ordinance to the Municipal Code Corporation for incorporation into the Monroe County Code of Ordinances.
