In accordance with Article 6 B of the original agreement dated May 15, 2002, the Contractor requests an annual adjustment in accordance with the percentage change in the Consumer Price Index for all urban consumers (CPI-U) for the most recent twelve months available. The above referenced contract contains a provision for a regular adjustment of the price based upon the changes of the Consumer Price Index for all Urban Consumers (CPI-U). Per contract and in consideration of ongoing operations, Synagro is requesting an annual adjustment to contract rates based on the Consumer Price Index for all Urban Consumers (CPI-U) published by the Department of Labor Statistics for May 2004. The latest published index for the period May 2003 to May 2004 shows an increased percentage change of 3.1 %.
