Resolution 106-1978RESOLUTION NO. 106-1978 TATHEREAS, the Board of County Commissioners of Monroe County, Florida, has received an application from the Florida Department of Transportation to construct a concrete pile supported reinforced concrete bridge; place fill (local limerock) above and below the mean high water line; dredge below the mean high water line to facilitate pile driving and bridge access; remove exist- ing bridge bulkheads at Bow Channel (SJN: 90020-3528), File No. 44- 37-4158, Monroe County (a copy of the application is attached and incorporated herein) and WHEREAS, this application has been reviewed and it has been determined that the project entertained would not: 1. violate any statute, zoning law, ordinance or other applicable restriction, nor 2. subject the natural flow of the navigable water as defined in Section 253.12, Florida Statutes, to harmful obstruction or alteration, nor 3. create harmful or increased erosion, shoaling of channels or stagnant areas of water, nor 4. cause material injury or monetary damage to accrue to adjoining land, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, has determined: a. whether the project will interfere with the conservation of fish, marine and wildlife or other natural resources to such an extent as to be contrary to the public interest; and, b. whether the destruction of oyster beds, clam beds, or marine productivity, including but not limited to destruction of natural marine habi- tats, grass flats suitable as nursery or feeding grounds for marine life, including established Page 1 of 2 Pages marine solids suitable for producing plant growth of a type useful as nursery or feeding grounds for marine life will result therefrom to such an extent as to be contrary to the public interest; And has also considered other factors affecting the public interest; and WHEREAS, the reports designated in Section 253.124, Florida Statutes, have been considered and read into the record at the same meeting at which final action has been taken on this appli- cation, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that said Board hereby gives its approval to the construction of the above project subject to the approval of the Department of Environmental Regulation pursuant to Section 253.124(2), Florida Statutes. GOVERNOR SECRETARY March 24, 1978 Monroe County Board of County Commissioners c/o Virginia Pinder Monroe County Courthouse Key West, Florida 33040 Gentlemen: File No. 44-37-4158, Monroe County Florida Department of Transportation Bow Channel (SJN: 90020-3528) The Department of Environmental Regulation staff has performed a biological survey for the above project and offers the following comments to be considered by the Board of Commissioners as required by Section 253.124(3), Florida Statutes. The applicant proposes to construct a 1,488 foot long by 38 foot 9 inch wide fixed span concrete bridge parallel and 50 feet north of the existing bridge centerline at Bow Channel. Pile caps will be extended 5 feet to support the Keys Aqueduct 24-inch water main. The existing bridge will remain; the existing wingwalls at the bridge ends shall be partially removed, hauled from the project and disposed of by the applicant's contractor. The remainder of the wingwalls shall be left in place and filled over. Bridge construction will require the placement of 20,397 cubic yards of material on the Miami end and 9,335 cubic yards of material on the Key West end, both landward and waterward of the mean high water line, to create the appropriate road slopes. Approximately 2,026 cubic yards of material will be dredged from 1.64 acres of submerged lands for piling installation and work barge access. All recoverable dredge material will be deposited on DOT upland right-of-way or bridge approach embankments. The project site encompasses submerged land, transitional zone and uplands. Submerged vegetation adjacent to the Miami end of the bridge includes turtle grass with several species of macroalgae (Halimeda spp., Laurencia spp., Chondria spp., and Batophora spp). Substrate is marl with rubble near the shoreline. Dense turtle grass beds were located away from the shoreline with Halimeda spp and Penicillus spp. along Monroe COUnty Board of County Commissioners Page Two March 24, 1978 with stunted turtle grass near the shoreline. On the Key West end of the bridge approximately 300 feet west of the bridge wingwall a dense stand of red mangroves has become established. These mangroves extend to DOT Station 616. In addition to red mangroves, black and white mangroves, buttonwood, Sea oxeye daisy, Christmas berry, poisonwood, sea grapes and various grasses are present. Adjacent to the Key West end of the bridge dense to sparse beds of turtle grass are present. In addition the area contains rubble that supports several species of macroalgae. Dense stands of red mangroves are present on both sides of the approach. In the fill area red and black mangroves are present that grade into buttonwood and other plant species common to the Keys. The project, as proposed, will fill 1.88 acres of transition land and 1.16 acres of submerged land. Pursuant to the requirements of Section 253.124(3), Florida Statutes, the preceding comments should be duly considered and read into the minutes of the meeting at which time a determination of local approval is made. To assist in evaluating the project a copy of the application and a set of project drawings are enclosed (Attachment I, II). A sample resolution (Attachment III) prepared also enclosed.
