Resolution 109-1978
RESOLUTION NO. 109_1978 WHEREAS, the Board of County Commissioners of Monroe County, Florida, has received an application from the Florida Department of Transportation to construct a concrete pile sup- ported reinforced concrete bridge; place fill (local limerock) above and below the mean high water line; dredge below the mean high water line to facilitate pile driving, and barge access; remove existing bridge and bulkheads at Torch Channel (SJN: 90020- 3531), File No. 44-37-4155, Monroe County (a copy of the applica- tion is attached and incorporated herein) and WHEREAS, this application has been reviewed and it has been determined that the project entertained would not: 1. violate any statute, zoning law, ordinance or other applicable restriction, nor 2. subject the natural flow of the navigable water as defined in Section 253.12, Florida Statutes, to harmful obstruction or alteration, nor 3. create harmful or increased erosion, shoaling of channels or stagnant areas of water, nor 4. cause material injury or monetary damage to accrue to adjoining land, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, has determined: a. whether the project will interfere with the conservation of fish, marine and wildlife or other natural resources to such an extent as to be contrary to the public interest; and, b. whether the destruction of oyster beds, clam beds, or marine productivity, including but not limited to destruction of natural marine habi- tats, grass flats suitable as nursery or feeding grounds for marine life, including established Page 1 of 2 Pages APFF;J\iEi / marine solids suitable for producing plant growth of a type useful as nursery or feeding grounds for marine life will result therefrom to such an extent as to be contrary to the public interest; And has also considered other factors affecting the public ineterst; and WHEREAS, the reports desingated in Section 253.124, Florida Statutes, have been considered and read into the record at the same meeting at which final action has been taken on this appli- cation, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that said Board hereby gives its approval to the construction of the above project subject to the approval of the Department of Environmental Regulation pursuant to Section 253.124(2), Florida Statutes. GOVERNOR SECRETARY March 27, 1978 Monroe County Board of County Commissioners c/o Virginia Pinder Monroe County Courthouse Key West, Florida 33040 Gentlemen: File No. 44-37-4155, Monroe County Florida Department of Transportation Torch Channel (SJN: 90020-3531) The Department of Environmental Regulation staff has performed a biological survey for the above project and offers the following comments to be considered by the Board of Commissioners as required by Section 253.124(3), Florida Statutes. The applicant proposes to construct a 820 foot long by 46 feet 9 inch wide fixed span concrete bridge parallel and 23 feet north of the existing bridge centerline at Torch Channel. Pile caps will be extended 5 feet on the north side of the bridge to support the Keys Aqueduct 24-inch water main. The existing bridge will be completely removed, hauled from the project and disposed of by the applicant's contractor. Bridge construction will require the placement of 6,176 cubic yards of material on the Miami end and 3,365 cubic yards of material on the Key West end, both landward and waterward of the mean high water line, to create the appropriate road slopes. Approximately 18,254 cubic yards of material will be dredged from 4.02 acres of submerged land for piling installation and work barge access. All recoverable dredge material will be deposited on DOT upland right-of-way or bridge approach embankments. The project site is undeveloped and is comprised of wetlands, transitional zone and uplands. The bridge approaches support typical Keys vegetation. Vegetation observed included red mangrove, buttonwood, sea oxeye daisy and sea myrtle. The primary impact to fish and wildlife resources will result from the elimination of productive benthic and intertidal communities from the proposed dredge and fill operations. Filling along the majority of the Key West end approach will eliminate a wide roadside band of large buttonwood and upland scrub. A stand of scrub red mangroves occurs between DOT stations 994 and 997. However, tidal inundation is impeded Monroe County Board of County Commissioners Page Two March 27, 1978 by the presence of an east -west road several hundred feet north of the project. This impediment reduces the ecological significance of the area. The greatest impact associated with this project will occur in the dredge area for work barge access where an intermittent flat, supporting patchy to dense coverage of Turtle grass and several species of algae, will be excavated. A stand of large, intertidal red mangroves extending 95 feet waterward of the existing northwest bridge abutment and several small red mangrove islands will also be eliminated. Additional loss of tidal red and black mangrove will occur along the approach at the Miami end of the bridge from DOT stations 1008 to 1012. The remainder of the approach supports non -tidal vegetation and filling operations are not expected to present significant environmental impacts. The project, as proposed, will fill 0.89 acres of transition zone and 0.72 acres of submerged land. Pursuant to the requirements of Section 253.124(3), Florida Statutes, the preceding comments should be duly considered and read into the minutes of the meeting at which time a determination of local approval is made. To assist in evaluating the project a copy of the application and a set of project drawings are enclosed (Attachment I, II). A sample resolution (Attachment III) prepared by the department's legal staff is also enclosed. This document is provided to assist the Board of Commissioners in preparing a resolution that will meet the requirements of Section 253.124(3), Florida Statutes. The Board of Commissioners is not obligated to use this format so long as the department is made aware that the requirements of the statute have been fulfilled.
