Resolution 116-1978 RESOLUTION NO.116 -1978 WHEREAS, the Board of County Commissioners of Monroe County, Florida, has received an application from M. B. Nowlin to construct a 60 foot long, 12 foot wide concrete seawall in line with the existing adjacent seawall, File No. 44-l3-l079-5E, M. B. Nowlin, Monroe County (a copy of the application is attached and incorporated herein) and WHEREAS, this application has been reviewed and it has been determined that the project entertained would not: 1. violate any statute, zoning law, ordinance or other applicable restriction, nor 2. subject the natural flow of the navigable water as defined in Section 253.12, Florida Statutes, to harmful obstruction or alteration, nor 3. create harmful or increased erosion, shoaling of channels or stagnant areas of water, nor 4. cause material injury or monetary damage to accrue to adjoining land, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, has determined: a. whether the project will interfere with the conservation of fish, marine and wildlife or other natural resources to such an extent as to be contrary to the public interest; and, b. whether the destruction of oyster beds, clam beds, or marine productivity, including but not limited to destruction of natural marine habi- tats, grass flats suitable as nursery or feeding grounds for marine life, including established marine solids suitable for producing plant growth of a type useful as nursery or feeding grounds for marine life will result therefrom to such an extent as to be contrary to the public interest; ~O:)'f\~--'~'~"~' ;' -'I ~j~ nK &..-----~. Box 92 Marathon, FL 33050 Dear Mr. Nowlin: Re: File No. 44-l3-l079-5E, Monroe County A biological assessment has been made of your proposal as follows: The applicant has proposed the construction of a 60' long, 12' wide concrete seawall in line with the existing ad- jacent seawall. This will be rip-rapped and backfilled to bring the elevation up to the existing grade. The project will extend into the water to approximately -1.8' MHW. The area of the proposed project is known as Jolly Roger Estates. It is subdivided into residential lots along canals and an offshore access channel. The elevation has been raised by filling with crushed limerock. Vegetation was predominantly scrub Australian pine (Casurina equiset- ifolia). Four homes were constructed in the vicinity. The project site is along an eroded crushed limerock fill shoreline. An access channel runs parallel to the shoreline 15' from the project site. Submerged vegeta- tion was primarily Batophora ~. with scattered Aceta- bularia~. Vegetation above MHW was scrub Australian pine, Sesuvium ~., scrub white mangrove (Laguncularia racemosa), and Sea lavender (Limonium carolinianum). continued . . . . . . ., ... Mr. M. B.
