A RE~~rtON OF ';l'HE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, VACATING A
PLAT OF BLOCKS 3, 5 & 7 OF ANGLERS PARK
SHORES SUBDIVISION. WITH,EXCEPTIONS. ~
WHEREAS, the Board of County Commissioners has heard
argument from representatives of the applicant, the general
public and the County with regard to the vacation of the above
plat; and
WHEREAS, the Board has considered the above argument along
with the "record" which includes but is not limited to: 1) the
William Hyde memorandum dated 1/7/92; 2) the Orders from Judge
Overby dated 3/18/91 and 9/9/91; 3) the minutes of the BOCC
meeting of 3/6/90 with regard to Ordinance No. 005-1990; 4) the
current scheduling correspondence file; 5) the current plat
vacation file and 6) the 1988 plat vacation file; and
WHEREAS, the Board is limited to consideration of the plat
vacation request as affected by Florida Statutes S 177 .101 and
Judge Overby's orders in Case No. 90-20410-CA-18; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
The requirements of Florida Statutes S 177 .101 support the
vacation of the plat (Blocks 3, 5 & 7 of Anglers Park Shores
Subdivision) with the exception that any public rights of way
that end at open water - whether canal or shoreline - may not be
vacated.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the lSh day of Ja~uarI' A.D., 1992.
