Resolution 158-1976RESOLUTION NO. 158 - 1976 RESOLUTION TRANSFERRING PROPERTY, TANGIBLE AND INTANGIBLE; EMPLOYEES, EMPLOYEE BENEFITS, CON- TRACTS, ASSETS AND LIABILITIES, RECORDS, ETC., OF THE MONROE COUNTY WASTE COLLECTION AND DISPO- SAL DISTRICT TO THE MONROE COUNTY MUNICIPAL SERVICE DISTRICT, EFFECTIVE OCTOBER 1, 1976. WHEREAS, by Special Act of the Legislature, 1976, the Monroe County Waste Collection and Disposal District is to be abolished effective September 30, 1976, and WHEREAS, by the terms of said legislative abolition, the Board of County Commissioners is declared to be the successor in government of said District with full authority to transfer all functions and duties including property of the District to the Monroe County Municipal Service District created by Ordinance No. 9 - 1975, and WHEREAS, the Board is desirous of making said transfer effective October 1, 1976, now therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AS FOLLOWS: 1. Effective October 1, 1976, all functions, duties, proprietorship, jurisdiction, powers, privileges, rights, immunities, obligations and corporate entity of the Monroe County Waste Collection and Disposal District are transferred to and shall henceforth vest in the Monroe County Municipal Service District. 2. That, effective October 1, 1976, the full title, rights, and ownership of property, tangible and intangible, including contracts, leases, interlocal agreements, subscriptions, rentals, official records, uncollected taxes, assessments, dues, claims, licenses, judgments, decrees, and choses in action together with the debts and obligations held or owned by the Monroe County Waste Collection and Disposal District are transferred to and shall vest with the Monroe County Municipal Service; all of which are itemized by Exhibit 1, pages 1 through 6 attached hereto and made a part of this Resolution. -2- 3. That, effective October 1, 1976, all employees of the Monroe County Waste Collection and Disposal District, including CETA employees, together with all employee benefits, such as accrued annual sick leave, annual leave, retirement and insurance benefits together with all other employee rights and benefits are transferred to the Monroe County Municipal Service District with full rights and benefits as previously held and enjoyed, at the same pay scale, position and job classification held under the abolished district. The employees, their positions, rate of pay, job classifications, accrued sick leave and annual leave, as of October 1, 1976, are as set forth in Exhibit 2, pages 1 through 3 attached hereto and made a part of this Resolution. 4. That this Resolution shall take effect October 1, 1976. DONE and ORDERED in open meeting this 28th day of September, A.D. 1976.
