Resolution 200-1976 RESOLUTION NO. 2oQ1976 RESOLUTION AUTHORIZING DIRECTOR OF ROAD DEPARTMENT AND MANAGER OF MUNICIPAL SERVICE DISTRICT TO CON- TRACT FOR SERVICES IN EMERGENCIES. WHEREAS, due to emergencies arising due to employee vacan- cies caused by illness, death, short notice resignations and other unanticipated situations, the Board of County Commissioners finds it exceedingly difficult to carryon essential Road Department and Municipal Service District programs, and WHEREAS, this resolution is a mechanism whereby in cases of extreme, dire emergencies, essential employee positions can be staffed on a contractual basis pending approval by the Board at a regularly scheduled meeting, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That the Director of the Road Department and the Manager of the Municipal Service District are each hereby authorized in situations of real emergencies where vacant employee positions jeopardize the operation of their department in that essential func- tions and duties must be provided without delay or interruption and the normal hiring and staffing procedures cannot be followed due to the time involved in processing said employment and the Board is not in regular or special session and no other County em- ployee is available from another department to fill said vacancy temporarily until said normal hiring procedures can be completed then, and only in that event, they are authorized to contract for services providing the following procedure is followed: a. At least one Board member must be contacted and informed of the necessity of such contracting, and verbally approves of same. b. That the contract for services be placed on the next regularly scheduled Board agenda for Board approval, and (0 -2- cases where continued employment is necessary that the individual so contracted be hired by the Board. c. That the individual so contracted with for services agrees in writing that his employment is only temporary and is not a contract for labor and will only continue until the next regularly scheduled Board meeting and that his continued em- ployment beyond said next regularly scheduled Board meeting may not be approved by the Board and that if it is not approved by the Board that his services will then cease except that he will be en- titled to compensation for his services from date of contract to disapproval at the existing rate of pay in effect for that position at the time of contracting except that no sick leave or annual leave shall accrue to him by virtue of his contract for services. d. The Clerk shall be notified of such contract for services and is authorized to make payment to said individual in accordance with paragraph c abovesaid. 2. It is the intent of the Board that the provisions con- tained herein shall be used only in emergency situations wherein no other qualified county employee is available to provide the service and the position vacant is a position which is absolutely vital to the effective functioning of the Road Department or Municipal Ser- vice District.
