RESOLUTION NO. 39 -1977
vffiEREAS, the Board of Adjustment of Monroe County, Florida,
at a public hearing held on October 8, 1976, duly called and held in
accordance with the zoning regulations of Monroe County, Florida,
and the laws of the State of Florida, considered the request of
Dr. Stephen Vuglen for a dimensional variance described as a lO-foot
variance from a roadway, and a 5-foot variance from a canal on two
sides on Lot 1, Block 2, of Snug Harbor Addition No.1, as recorded
in Plat Book 4, Page 155, and located in Section 2, Township 66
South, Range 28 East (Summerland Key), and
WHEREAS, after hearing all persons to be heard, said Board
approved the request for the dimensional variance, and
WHEREAS, Dr. F. A. Morrison filed an appeal with the Board
of County Commissioners of Monroe County, Florida, acting as the
Board of Appeals, asking the Board to reverse the decision of the
Board of Adjustment in accordance with the laws applicable thereto,
and
WHEREAS, on the 1st day of March, 1977, the Board of
County Commissioners of Monroe County, Florida, acting as the Board
of Appeals held such appeal, and after reviewing the record and
proceedings and said action taken at said public hearing on October 8,
1976, and taking testimony and hearing all persons desiring to be
heard, voted to uphold the decision of the Board of Adjustment and
grant the dimensional variance, and
WHEREAS, it is necessary to pass a resolution confirming
the above action of said Board of County Commissioners acting as
the Board of Appeals, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, ACTING AS THE BOARD OF APPEALS, that the
decision of the Board of Adjustment made at the public hearing on
October 8, 1976, approving the request of Dr. Stephen Vuglen for a
dimensional variance described as a lO-foot variance from a roadway,

and a 5-foot variance from a canal on two sides on Lot 1, Block 2,
of Snug Harbor Addition No.1, as recorded in Plat Book 4, Page 155,
and located in Section 2, Township 66 South, Range 28 East (Summerland
Key), is hereby upheld and the said Dr. Stephen Vuglen is hereby
granted a dimensional variance on the above described property.
