RESOLUTION NO. 40 -1977
WHEREAS, the Board of Adjustment of Monroe County, Florida,
at a public hearing on November 5, 1976, duly called and held in
accordance with the zoning regulations of Monroe County, Florida, and
the laws of the State of Florida, considered the request of Alfred B.
Lichtenstein and I1ai B. Lichtenstein, Lloyd M. Munson and Elaine
Munson, Henry Zakowski and Betty Zakowski, John A. Bender, Bernard K.
Oldham and Nora B. Oldham, and Clifford D. Steves and Marianne Steves
for an Administrative Appeal challenging an administrative ruling
of the Director of Zoning of Monroe County, Florida, in connection
with a requirement of a Major Development Ordinance, to-wit: "An
activity or use which includes the construction of buildings in
excess of forty-five (45) feet in height", on Block 17, Indies Island,
Duck Key, Monroe County, Florida, and
WHEREAS, after hearing all persons to be heard, said
Board denied the request to declare Block 17 a Major Development
Project, and
WHEREAS, Mr. John A. Bender, Mr. Bernard K. Oldham, and
Mr. Clifford D. Steves filed an appeal with the Board of County Com-
missioners of Monroe County, Florida, acting as the Board of Appeals
asking the Board to reverse the decision of the Board of Adjustment
in accordance with the laws applicable thereto, and
WHEREAS, on February 15, 1977, the Board of County Commis-
sioners of Monroe County, Florida, acting as the Board of Appeals
held such appeal, and after reviewing the record and proceedings
and said action taken at said public hearing on November 5, 1976,
and taking testimony of all persons desiring to be heard, voted to
uphold the decis-ion of the Board of Adjustment and deny the request
to declare Block 17, Indies Inn, Duck Key, Monroe County, Florida, a
Major Development Project, and
WHEREAS, it is necessary to pass a resolution confirming
the above action of said Board of County Commissioners acting as
the Board of Appeals, now, therefore,

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, ACTING AS THE BOARD OF APPEALS, that the
decision of the Board of Adjustment made at the public hearing on
November 5, 1976, denying the request to declare Block 17, Indies
Inn, Duck Key, Monroe County, Florida, a Major Development Project
is hereby upheld, and the appeal is hereby denied.
