Resolution 048-1977RESOLUTION' #4'8-1977 WHEREAS, it has come to the attention of the Board x .of County Commissioners of Monroe County, that the Clerk of the Circuit Court of Monroe County is, from time to time, and in the performance of his official' duties and responsibilities, in need of legal advice and representation from competent legal counsel, and, WHEREAS, Attorney General Opinion 76-100, issued May 6, 1976, provides that where a County'Attorney is.available, qualified and authorized to render legal services to the Clerk of the Circuit Court;,: then, in absence of exceptional circumstances, the Clerk should not expend funds of his office to obtain add- itional"private legal counsel but should rely on the County Attorney for legal assistance in the operation of the Cle'rk'.s Office, and, WHEREAS,, it is apparent to the Board of County Com- missioners of Monroe County that the duly appointed and retained County Attorney for Monroe County is without the necessary staff to.provide full time legal representation to the clerk of the Circuit Court of Monroe County in addition to his representation of the Board of County Commissioners of Monroe County and such other officers and agents of the.County as provided by this Board, and, WHEREAS, a substantial portion of the legal services and representation required by the Clerk -of the Circuit Court, arise from and involve matters relating to the County and its Board of County Commissioners and other agents, presenting numerous instances of,potential or actual conflicts of interest, NOW, BE IT THEREFORE. -RESOLVED that the Clerk of the Circuit Court of Monroe County is authorized to retain such private counsel where there exist a conflict of interest as he should deem necessary for the proper representation and oper- ation of that office,.
