WHEREAS, The Florida Department of Natural Resources,
Division of Recreation and Parks has agreed to enter into a
contract with the County of Monroe, State of Florida, under
the Florida Boating Improvement Program for the purpose of
developing the Little Torch Key Project, and
WHEREAS, Monroe County has agreed to operate and main-
tain said recreational boating facilities and improvements
after same have been completed and desires to enter into said
agreement, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that it hereby agrees to enter into
agreements with the Florida Department of Natural Resources,
Division of Recreation and Parks for the following boating
improvement project:
1. Little Torch Key Boat Ramp
and that the Mayor and Chairman and the Clerk of said Board
be and they are hereby authorized to execute said agreement
on behalf of said County.
BE IT FURTHER RESOLVED BY SAID BOARD that certified
copies of this resolution be forwarded to the Florida Department
of Natural Resources, Division of Recreation and Parks together
with executed copies of said agreement.

Florida.Boating Improvement Program Project Agreement
THIS AGREEMENT, dated this 7th day of June
19 77, by and between the Department of Natural. Resources, Division
of Recreation and Parks, hereinafter referred to as Department, and
the County of Monroe hereinafter referred to as County.
W I T N E S S E T H:
That in and for the mutual covenants between the Department and the
County, it is agreed as follows:
1. The Department has found recreational boating improvement to be
the primary purpose of this project known as Little Torch Key Ramp
and has agreed to enter into this contract with the County for
development of recreational boating facilities and/or improvements,
such developments being in accordance with the project plans attached
hereto and made a part of this Agreement as Exhibit "A
2. The County agrees to operate and maintain said recreational
boating facilities and/or improvements once completed and covenants
that is has the full legal authority and capability to so operate
and maintain said facilities and/or improvements.
3. The County agrees to commence construction of the project on
or before November 1, 1977, and further agrees to complete said project
on or before November 1, 1978
. If in the event construction of
the project does not commence on or before November 1, 1977 , or is not
completed on or before November 1, 197$ the County agrees to return to
the Department any and all unexpended funds originally allocated for
said project.
4. The County agrees to appoint an official liaison aclent to be
responsible for the successful completion of the project, the prompt
.'imple.mentaLion of the articles of this Agreement, and the submission of

progress reports at least every (60) sixty days from the date of the
execution of this Agreement until the project is certified complete by
resolution duly adopted by the County.
S. The Department agrees., in consideration of the promises made
by the County herein, to tender to the County funds in the amount of
$16 400 00 to be used specifically for the
development of recreational boating facilities and/or improvements
as defined in Exhibit "A" of this Agreement.
6. In the event there exist.unexpended or unobligated funds
at th,e completion of the project, as described in Exhibit "A", attached
hereto and made a part of this agreement, the County agrees to return
said unexpended, unobligated funds to the Department within 60 days
after project completion.
7. In the event the County elects to implement a user fee
system for the Little Torch Key Ramp or for any facility within the
- - NA - ---- boundaries, the County agrees to impose such
fees uniformly among the users regardless of the political jurisdiction
in which the user may reside.
8. T.he.Department reserves the right to inspect the site and
facilities, as well as the right to audit any and all financial
records pertaining to this project at reasonable times.
9. Any inequities that subsequently appear in this Agreement
shall be subject to negotiation upon written request of either party,
and the parties agree to negotiate in good faith as to any such inequities.
10. This Agreement is executed in duplicate, each copy of which

IN WITNESS THEREOF, the parties hereto executed this agreement
