NOW, moUUI)RE, 711IS INDENJURE V?ITNFSS=i: That in consideration of the premises and covenants hereinafter,set forth to be kept and performed by each of the parties hereto, it is hereby mutually covenanted and agreed as follow 1. The Departninnt will add Job No. 90550-3616, .on Raccoon Key, streets in Key -Haven Subdivision 8th and 10th additions to the state secondary mad system and construct or reconstruct said project charging all costs of the project to gasoline tax funds accruing to the Department for use in MONROE ant, under the provisions of Florida Statutes, Section 208.44, an Article IX of the Constitution of the State of Florida and the construction or reconstruction of said project will be in cm9liance with roquirem:nts of the Florida Statutes an the Dcpartmrt Regulations relating to expenditure of secondary gasoline tax funs and construction of roads on the state secondary road system. 2. Said work shall be performed under the Department's supervision in accordance with the specifications of the Deportment. 3. Upon curpletion and acceptance by the Department of said road, high..•ay, nuuicipal connecting link, or city street, it is understood and agreed that the DepartamnE will retain said road, higlr•ay, mmicipal connecting link or city street on the secondary syston and perform maintenance in accordance with the u;:ual standards for maintenance of the DeparUrent and under the supervision of the-Departmant's State 11iglneay Engineer. 4. The County agrees to the expenditure of all funs necessary for the maintenance on a current basis of the aforementioned project, said sums to be deducted fm-n the County's secondary gas tax accruals on a current basis. 5. The County agrees to indamufy, defend, save and hold harmless the Department fran any and all claims of any nature whatsoever arising out of or because of thia Agrec=- t. Dear Sir-: We are pleased to advise that we will receive bids in the Auditorium of the State of Florida Department of Transportation, Tallahassee, Florida, until 10:30 A.M. (EDST) on Thursday the 23rd day of October, 1969, on the above project. A cordial invitation is extended mo any representatives of your County .to be present at this letting. After the bids are tabulated you will be advised as to the low bidder and will be furnished a complete tabulation of all bids received. As we have previously advised you, the Florida Statutes require a maintenance. agreement for each secondary project. Since it is my understanding that it is the wish of the County that this project be retained on the secondary.system'and main- tained by the Department upon completion of construction, we are enclosing a standard agreement form in which the Department agrees to retain the project on the secondary system and assume maintenance upon the completion of construction. It will be greatly appreciated if your Board will execute the agreement at your: earliest convenience and return two executed copies to the Engineer of Secondary Roads, Department of Transportation, Tallahassee, Florida, for execution by the Department.
