HomeMy WebLinkAboutResolution 009-1968 RESOLUTION NO. 9 -1968 SECONDAR Y ROADS WHEREAS, Monroe County, Florida desires to acquire the necessary road rights-of-way to extend County Road S-905 northward from Lake Sur- prise to the county line and Broad Creek, and WHEREAS, Seaboard Properties, Inc. desires to sell the necessary right-of-way through its properties for cash and other good and valuable considerations, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that said Board hereby agrees to purchase the right-of-way as shown on the attached R/W map, subject to the following terms and conditions: 1. The County agrees to pay $62, 300.00 for the property which includes full and final compensation for removal and for relocation of the Gate House and Air Terminal Building, relocation and rebuilding of portions of the golf course, and for landscaping changes and any and all other damages. 2. If and when the roadway is actually constructed through and beyond Ocean Reef, the following conditions shall be met: (a) The construction project must include a bridge over Angelfish Creek, having a vertical clearance of at least 10' above mean high water. (b) The bridge over Pumpkin Creek shall have a mlUlmUITl vertical clearance of 10' above mean high water. (c) In the area of the Ocean Reef Airstrip, the centerline profile grade of the roadway shall not be more than 18" above the centerline profile grade of the existing runway. It is the intent of this provision to prevent construction which would tend to impede the flow of hurricane tides through this low area. (d) Angelfish Creek must be maintained as a navigable channel with no interruption of marine traffic. If Broad Creek is made the navigable channel between the intra- coastal waterway and the Atlantic Ocean, Seaboard Prop- erties would not object to this substitution, provided how- ever that no restrictions be placed in Angelfish Creek until such time as Broad Creek is completely dredged out and available to marine traffic. BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of said Board be, and he is hereby authorized to forward certified copies of this Resolution to the State Road Department for appropriate action.
