WHEREAS, the State Road Department of Florida has established loca-
tion for that part of State Road , designated as Section 90504 ,
Job 2606 ,between State Road 5 and Northerly on Sandy Cove Ave. and Easterly
on Sapodilla Drive in Matecumbe Sandy Beach Subdiv.; ALSO from State Rd. 5 South-
erly and Easterly on Columbus Drive, and Easterly on Cortez Drive from Columbus
Drive in Matecumbe Ocean View Subdivision;
and proposes to construct and maintain the same as a part of its Secondary Road
program; and, Whereas, Monroe County is vested with all right
of way required for said road;
NOW, THEREFORE, the Board of County Commissioners of Monroe
County does hereby affirm that it is vested with all of the required right of
way for said portion of said State Road, and that said right of way is legally
clear and has been physically cleared of all buildings, fences and other im-
provements; that all utility poles, lines, cables, pipes and other facilities
have been removed or adjusted as required for constructi on of said proj ect by
the State Road Department or such removal, and/or adjustments have been ar-
ranged for and will be effected without delay to the State Road Department
and/or its contractors; and the State Road Department is hereby requested to
proceed with the construction and maintenance of said portion of said State
Road; and Monroe County hereby agrees to save harmless the
State Road Department, its contractors, agents and employees, from all claims
arising out of such construction and maintenance of said road within the right
of way aforesaid and to defend any and all lawsuits to ccmpletion and satisfy
any and all judgments therein made, at the County's expense.
NOW, THEREFORE, the Board of County Commissioners of Monroe
County, does hereby authorize the execution of a deed conveying the herein-
above described property to the State of Florida for the use and benefit of the
State Road Department.

STATE ROAD DEPARTMENT RIGHT OF WAY RESOLUTION
WHEREAS, pursuant to due authorization, the State Highway Engineer has had
a part of State Road Nii 5 in Monroe County located and surveyed and
has designated same as Section 90504 :; and has prepared a Map of Survey and
Location of that portion of said Sedtian including parts of Streets on Lower
Matecusnoe Key,
NOW, THEREFORE, BE IT RESOLVED by the State Road Department that it hereby
approves the location and survey of said portion of said Section as shown on said
map and directs that a copy of said map, certified by the Director, attested by the
Secretary, be filed in the Office of the Clerk of the Circuit Court of said County;
and
BE IT FURTHER RESOLVED that it is the judgment of the Department that the
construction of said portion of said Section is necessary, practical and to the best
interest of the State, and that it is necessary that the right of way for the road-
bed, ditches, and borrow pits for said portion of said Section be acquired; and that
the State Road Department is authorized to acquire the same by gift, purchase or con-
demnation; and
RF, IT FURTHER RESOLVED by the Department that said County be, and it is
hereby requested and authorized, to secure by gift, purchase or condemnation the
lands necessary for the right of way for the roadbed for said portion of said Section
as shown on the official right of way map of said Section, together with any and all
easements for drainage ditches and borrow pits that may hereafter be found and de-
termined necessary in the construction and maintenance of said portion of said Sec-
tion, said land to be free of legal and physical encumbrances; and
BE IT FURTHER RESOLVED, that in the event the County agrees to secure the
right of way for the roadbed, ditches and borrow pits for said portion of said Sec-
tion, that the Director of the Department is hereby authorized to execute for the ,;
Department the usual Right of Way Contract with the County.
