Resolution 067-1966 COUNTY COMMISSIOI~S RESOLUTION NO. 67-1966-SECONDARY ROADS On motion of Connnissioner Pri tchard , seconded by Commissioner Freeman the following resolution was adopted: WHEREAS, the State Road Department of Florida has authorized and re- quested l'Jonroe County to furnish the necessary rights of way, borrow pits and easements for that portion of Section 90505, including parts of streets on Key Largo, which has been surveyed and located by the State Road Department as shown by a map on file in the office of the Clerk of the Circuit Court of said County, and in the office of the said Department at Tallahassee, and T^!tlERR~ S, the said D(~partment will not begin constn:ction of s8.id portion of so.:icl Sectj.on in aaid County until title to all :Land. n8celo'::;:"l7 for r;aid portion of said Se~tion has been conveyed to or ve8ted in said State by said County, and said lands ere physically cleared of all occupants, teuants, f':mceB, buildings and/or other structures and improvemeu'(,s upon or encroach- ing 1dthin the limits of the land required for said portion of said Section; and WHEREAS, the Gaid County is financially unr->,ble at this time to provide the necessary funds to acquire said rights (.f way, borrOvl pits and e;;,,,ements; now therefore, be it RESOLVED, that the State Road Department of Florida be and it is hereby requested to pay for the rights of way, borrow pits and easements for said road, including the removal of buildings, fences and other structures and improvements thereon, and for other expenses of ?',c<luiring title to said rights of way, borrow pits and easements by v~rch~~e or condemnation, from proceeds of Florida State Development Commission bonds or secondary gasoline tax funds (Section 16, Article IX, of the Florida Constitution, Chapter 26321, Laws of Florida, Extraordinary Session, 1949), whichever is available, under conditions set forth in the contract, of which this resolution forms a part; and be it f'urther RESOLVED, that said County, through its Board of County Commissioners, comply with the request of said Department and procure, conveyor vest in said State the free, clear and unencumbered title to all lands necessary for said portion of said Section, and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings and/or other structures and improvements situate upon or encroaching within the limits of the lands required for said portion of said Section and that the Chairman and the Clerk of this Board be and they are hereby 8uthorized and directed to execute ~nd deliver on behalf of said County to said DerMrtment the Contract in the form hereto attached; and be it further RESCLVED, th~t the attorney for this Board be, and he is hereby authorized and directed to proceed to take the necessary steps fer the County to ~cquire in t~e name of said County by donation, purchase, or condemnation said rights of way, borrmr pits and easements for said portion of said Section, and to prepare in the name of sfl,id County by its County Commi,r.. loners all condernllation pJ.pcn;, affidiwi ts and pleadings, and procecute all conc~2nmation proceedings to JuJgment; and furnish to the Department the abstract Gearch provided for in said Contract.
