Commander, Navy Installations Command, Millington Detachment, is responsible for Navy-wide administration and management of Morale, Welfare and Recreation (MWR) activities. Navy MWR activities on board, or otherwise serving military commands at, Naval Air Station, Key West, Florida, are components of the U.S. Department of Defense that performs an essential government function, and, as such, it enjoys the legal status of an instrumentality of the United States. The U.S. Navy, as a government agency and a Department of Defense component, pays claims that are adjudicated to be meritorious by either appropriate administrative personnel or by U.S. Court decisions under the Federal Tort Claims Act. The government of the United States is by law self-insured. Claims adjudicated against the U. S. Government are paid under the General Judgment Fund [See 10 USC ~1304 (a) (1988)]. Similarly, claims adjudicated against an MWR activity (a nonappropriated fund instrumentality of the United States) are also paid with government funds administered through the self-insurance program maintained by CNI, Millington Detachment. Coverage under MWR's Property and Casualty Self-Insurance Program provides for a combined single limit of $1,000,000.00 for injury, death or property damage for such third party liability claims. In both instances, the United States Government is self-insured, and as a mater of federal law, shall not assume legal responsibility for any non-federal entity or person.
