RESOLUTION NO.
1 -1970
WHEREAS, Maxwell L. Chrow filed an appeal with the Board of
County Commissioners of Monroe County, Florida, requesting said Board
to reverse the decision of the Zoning Board of Monroe County, Florida,
granting a Special Use Permit (Variance to permit the expansIOn of an ex-
isting non-conforming use) on Lot 10, Barry Beach, Plat Book 2, Page
127, Monroe County, Florida, to Anthony L. Ulchar, and
WHEREAS, on November 12, 1969, the Board of County Commission-
er s voted to uphold the decision of said Zoning Board and deny said appeal,
and on November 25, 1969 adopted Resolution No. 114-1969, upholding the
decision of said Zoning Board, and
WHEREAS, the said Maxwell L. Chrow, appellant therein, was in-
advertently not notified of the adoption of said Resolution, and was unable
to request a re -hearing within the time allowed by law, and
WHEREAS, the Board of County Commissioners agreed to hear the
said Maxwell L. Chrow's request for re-hearing on January 13, 1970, and
at said hearing it was discovered that no transcript of the hearing before
the Zoning Board was available for consideration by the Board of County
Commissioners, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, as follows:
1. That Resolution No. 114-1969, adopted by said Board on November
25, 1969, be, and the same is hereby rescinded.
2. That the request of Maxwell L. Chrow for a re-hearing on said
matter be referred to the Zoning Board of Monroe County, Florida, to re-
consider the request of the said Anthony L. Ulchar for a Special Use Per-
mit (Variance to permit the expansion of an existing non-conforming use)
on Lot 10, Barry Beach, Plat Book 2, Page 127, Monroe County, Florida,
and to make a transcript of the proceedings before said Zoning Board.
